Colorado shooting victims' families blast fundraising charities

AURORA, Colorado (Reuters) - Families of people killed and wounded in a shooting rampage inside a Colorado movie theater in July said on Tuesday they were being denied a voice in how $5 million in donations raised to help them was being dispersed.

Tom Teves, whose son Alex was killed, said the first disbursement of funds went to various charities instead of victims and that a committee charged with distributing the money does not have any victims or their families on it.

"We are certain that everyone who donated their hard-earned wages intended for 100 percent of their donations to go directly to the victims," Teves said. "Unfortunately, it does not seem to be the case."

In an emotional news conference, 18 people representing families of the 12 who were killed and 58 who were wounded in the shooting accused some charities of soliciting funds by using victims' photographs without permission.

The Community First Foundation said $350,000 had been given directly to the victims or their families. The foundation, which manages the Aurora Victim Relief Fund, said it was dispersing money through smaller local charities that are responsible for distributing it to victims and their families.

Teves said $5,000 was given to each of the 70 victims' families only after they threatened to make public their concerns.

"The victims of 9/11 had similar issues with non-profit organizations keeping the donations from directly going to the victims until a handful of families put a stop to it," Teves said.

Community First's Executive Vice President Cheryl Haggstrom said, "We don't have direct communication with the families, but have been relying on professionals from police to the district attorney's office and victim advocates for them to tell us when it's the best time to include them."

She said the foundation was in the process of arranging a meeting with victims to get their input.

Former University of Colorado graduate student James Holmes, 24, is accused of opening fire inside the theater in Aurora on July 20 during a midnight screening of the Batman movie, "The Dark Knight Rises". He is being held in solitary confinement and without bond in the Arapahoe County jail.

U.S. Navy veteran Josh Nowlan, 32, who was severely wounded in the shooting, said he was slowly recovering but added that he knows families of those who died were suffering. "If I was a millionaire, I would give every dollar of it to them," he said.

Balancing act for India in overhaul of archaic land ... - Real Estate India

MUMBAI: More than a century after it was drawn up by British colonial rulers, India?s land acquisition law is finally set for a revamp that promises to breathe life into scores of frozen industrial and infrastructure projects and help lift the sagging economy. That?s the optimistic scenario. The reality is that the new law will make the cost of land much higher for businesses and is unlikely to put a stop to protests by millions of people determined to defend their livelihoods or get fair compensation for losing their land.

The new bill will govern land acquisition by the government for itself and by private firms to provide public services. This will embrace a wide range of projects in sectors from power and telecommunications to transport and education. Among the major projects which have stalled awaiting the new legislation are 12-million-tonne steel plants planned by?Posco?and?ArcelorMittal?and a six-million-tonne steel plant of?Tata Steel?in Odisha, as well as Coal India?s mine expansion in Chattisgarh. More than 80 highway projects are also running behind schedule.

Despite the promise of greater transparency and better regulation, corporate India is worried about cost. The new law may force them to pay four times the market price for land in rural areas and twice the market price in urban areas, and give displaced people homes, jobs, monthly stipends and even a share of their profits in some cases. Even if companies enter into private negotiations for land, they will be required to rehabilitate people if they acquire over 100 acres of rural land or 50 acres in urban areas.

The Confederation of Indian Industry lobby group estimates that this will increase land acquisition costs by 3-3.5 times, affecting the viability of projects across the board. Companies are bracing for increased costs and may tweak project plans, but they?re unlikely to ditch projects altogether, having invested years negotiating with state governments and landowners. ArcelorMittal?s boss?Lakshmi Mittal?said recently his India projects were unlikely to see light for several years because of unresolved policy issues. But a spokeswoman said they were continuing negotiations despite likely cost increases.

The government has tried twice to amend the 118-year-old legislation, but until now it has failed to balance demands for an end to the regulatory minefield that confronts developers with a popular clamour to protect the poor. Even as the government prepared last week to introduce its latest version of the Land Acquisition act in parliament, social activists gathered in New Delhi to protest against a law their leaders said falls ?far too short of democratic expectation?.

Hello,

Once again it has been quite some time that I have had a chance to write, it's been a busy 6 months with the usual plate spinning : )

As a bit of insight I thought I'd share how my brain works, I have quite a visual mind and often see myself quite literally juggling the main components of my life - motherhood, relationship, extended family, work, health, home, social life (tres scaled down!) and finances.

I used to see each area of life as a bucket and my aim was to ensure that everything was evenly filled - I'd make sure that I was balancing everything correctly, I could see what area's required more attention and I'd be able to see the areas which were doing just fine.

Anyway, my thought processes became a lot less than orangised and it became more like a circus in my mind. Maybe now that I?m thinking more rationally I realise that I didn't really HAVE to do half the things I thought I had to - cleaning the front door and path at 10pm on a Monday after coming home from work, cooking dinner (twice) bathing and putting Freya to bed is probably one of those things I didn't really have to do - Anxiety 0 - 1 Amy, thankfully that's in much better check now and things are just as productive yet much more calmer although I am still trying out this pretty new thing to me, it?s called - TAKING IT EASY!!!

It's actually not the easiest thing to do but I have little choice at the moment because my back pain made a devilish return. I am actually pretty fed up of talking about it and feeling it but its so flippin' consuming there?s not much room for anything else to think about!

I have scoliosis which means I have a curved spine and its compressing my nerves, pretty horrid really, I am coming closer to the end of a 6 month waiting list (and my tether!) to receive injections which will block the pain for another year - hooray!

I don't want Freya to miss out on things because of my problem. It's also increasingly painful sitting at a desk, the only relief I get is when I'm lying down - hardly possible to do very often except at bed time but I am trying to do it more in the evenings, and occasionally under my desk when it gets too much, I have to work and I enjoy my job but jeepers I don?t enjoy sitting at a desk at the moment!

I have a plan to see if I can be treated in a shorter space of time, well its a brain storm and tomorrow will be the day of taking action, making more calls and getting my back fixed so I can live the life that my mind wants to... (might have to give the skydive a miss in this life time) but I'm a Piscean, a dreamer ? and I can see a healthy happy person at the end of this!

On a side note, I think having a little artistic outburst and a chat with my friend Sara at her art workshop (Reclamation) today help, it really lifted my spirits and reminded me to keep in touch with my creative side; I loved using crayons to express my take on life as a mum!

ScienceDaily (Aug. 26, 2012) ? Women with acute heart failure have similar in-hospital mortality to men but are less treated in the real world, according to results from the global ALARM-HF registry presented August 26 at the ESC Congress 2012. The findings were presented by Dr John T. Parissis from Greece.

Acute heart failure (AHF) is a frequent clinical situation with high short- and long-term mortality as well as high hospitalization rates. The Acute Heart Failure Global Registry of Standard Treatment (ALARM-HF) is an in-hospital chart audit survey which includes patients hospitalized for AHF in Europe, Latin America and Australia. A total of 4,953 patients admitted to Cardiology Departments (67%) or Intensive Care Units (33%) for AHF in 666 hospitals among 9 countries (France, Germany, Italy, Spain, UK, Greece, Turkey, Mexico and Australia) were enrolled. Women accounted for 37% of the study population.

The present study is a sub-analysis of ALARM-HF, targeted to explore gender-related differences in patients hospitalized for AHF. The researchers found significant differences between women and men in clinical presentation, co-morbidities, precipitating factors and treatment patterns. Length of stay and in-hospital mortality were similar in women and men.

Compared to men, women presented with AHF at an older age and with higher rates of de novo heart failure. Based on AHF classification, women were less than half as likely to present with cardiogenic shock than men, but more than twice as likely to present with right heart failure.

Women presented on admission to hospital with higher systolic blood pressure and higher heart rate. Women had higher left ventricular ejection fraction and the majority of women had preserved ejection fraction.

Regarding co-morbidities, when compared to men, women more frequently had atrial fibrillation, valvular heart disease, diabetes mellitus, obesity, anemia and depression. But women had lower rates of cardiomyopathy, coronary artery disease (CAD), dyslipidemia, smoking and asthma or chronic obstructive pulmonary disease (COPD) than men. There were similar rates of arterial hypertension and peripheral vascular disease in both genders.

In both genders, acute coronary syndrome (ACS) was the most common precipitating factor for AHF. However, women were less likely than men to have ACS and more likely to have infection or worsening valvular heart disease.

On admission, a lower percentage of females were on angiotensin II receptor blockers (ARBs), beta-blockers, aspirin and clopidogrel due to the presence of underlying co-morbidities and less CAD. However, more females were on digitalis and vitamin K antagonists due to the higher incidence of atrial fibrillation.

Regarding interventions, continuous positive airway pressure (CPAP) and mechanical ventilation were equally offered to females and males. Fewer females underwent percutaneous coronary intervention (PCI), coronary artery bypass graft (CABG) surgery and were supported by intra-aortic balloon pump (IABP).

Despite the improvement of medical management at discharge, the aforementioned differences in pharmaceutical therapies (especially in beta-blockers) remained in favour of males.

Mean length of stay in a coronary or intensive care unit (CCU/ICU) was similar between genders. Importantly, the overall in-hospital mortality and the in-CCU/ICU mortality were also similar in females and males. "The presence of higher ejection fraction and less CAD in women may positively affect survival in women," said Dr Parissis, who is assistant professor of cardiology at the University of Athens in Greece and a member of the ALARM-HF Steering Committee. "On the other hand, the existence of other serious co-morbidities and under-prescription of life saving medications such as beta-blockers may counteract this positive effect on their in-hospital survival. This point may explain the similar mortality rate between genders."

"The presence of diverse predictors and pharmaceutical modalities may explain the similar in-hospital mortality rates in both genders," he added. "Perhaps there are differences in the pathophysiology of AHF between women and men which should be taken into account in order to achieve gender-tailored management. Finally, a more intensive implementation of heart failure guidelines is required to optimize life saving medications especially in women."

Most mutations come from dad: New insights into age, height and sex reshape views of human evolution

ScienceDaily (Aug. 23, 2012) ? Humans inherit more than three times as many mutations from their fathers as from their mothers, and mutation rates increase with the father's age but not the mother's, researchers have found in the largest study of human genetic mutations to date.

The study, based on the DNA of around 85,000 Icelanders, also calculates the rate of human mutation at high resolution, providing estimates of when human ancestors diverged from nonhuman primates. It is one of two papers published this week by the journal Nature Genetics as well as one published at Nature that shed dramatic new light on human evolution.

"Most mutations come from dad," said David Reich, professor of genetics at Harvard Medical School and a co-leader of the study. In addition to finding 3.3 paternal germline mutations for each maternal mutation, the study also found that the mutation rate in fathers doubles from age 20 to 58 but that there is no association with age in mothers -- a finding that may shed light on conditions, such as autism, that correlate with the father's age.

The study's first author is James Sun, a graduate student in Reich's lab who worked with researchers from deCODE Genetics, a biopharma company based in Reykjavik, Iceland, to analyze about 2,500 short sequences of DNA taken from 85,289 Icelanders in 24,832 father-mother-child trios. The sequences, called microsatellites, vary in the number of times that they repeat, and are known to mutate at a higher rate than average places in the genome.

Reich's team identified 2,058 mutational changes, yielding a rate of mutation that suggests human and chimpanzee ancestral populations diverged between 3.7 million and 6.6 million years ago.

A second team, also based at deCODE Genetics (but not involving HMS researchers), published a paper this week in Nature on a large-scale direct estimate of the rate of single nucleotide substitutions in human genomes (a different type of mutation process), and came to largely consistent findings.

The finding complicates theories drawn from the fossil evidence. The upper bound, 6.6 million years, is less than the published date of Sahelanthropus tchadensis, a fossil that has been interpreted to be a human ancestor since the separation of chimpanzees, but is dated to around 7 million years old. The new study suggests that this fossil may be incorrectly interpreted.

Great Heights

A second study led by HMS researchers, also published in Nature Genetics this week, adds to the picture of human evolution, describing a newly observable form of recent genetic adaptation.

The team led by Joel Hirschhorn, Concordia Professor of Pediatrics and professor of genetics at Boston Children's Hospital and HMS, first asked why closely-related populations can have noticeably different average heights. David Reich also contributed to this study.

They examined genome-wide association data and found that average differences in height across Europe are partly due to genetic factors. They then showed that these genetic differences are the result of an evolutionary process that acts on variation in many genes at once. This type of evolution had been proposed to exist but had not previously been detected in humans.

Although recent human evolution is difficult to observe directly, some of its impact can be inferred by studying the human genome. In recent years, genetic studies have uncovered many examples where recent evolution has left a distinctive signature on the human genome. The clearest "footprints" of evolution have been seen in regions of DNA surrounding mutations that occurred fairly recently (typically in the last several thousand years) and confer an advantageous trait, such as resistance to malaria. Hirschhorn's team observed, for the first time in humans, a different signature of recent evolution: widespread small but consistent changes at many different places in the genome, all affecting the same trait, adult height.

"This paper offers the first proof and clear example of a new kind of human evolution for a specific trait," said Hirschhorn, who is also a senior associate member of the Broad Institute. "We provide a demonstration of how humans have been able to adapt rapidly without needing to wait for new mutations to happen, by drawing instead on the existing genetic diversity within the human population."

Average heights can differ between populations, even populations that are genetically very similar, which suggests that human height might have been evolving differently across these populations. Hirschhorn's team studied variants in the genome that are known to have small but consistent effects on height: people inheriting the "tall" version of these variants are known to be slightly taller on average than people inheriting the "short" versions of the same variants.

The researchers discovered that, in northern Europe, the "tall" versions of these variants are consistently a little more common than they are in southern Europe. The combined effects of the "tall" versions being more common can partly explain why northern Europeans are on average taller than southern Europeans. The researchers then showed that these slight differences have arisen as a result of evolution acting at many variants, and acting differently in northern than in southern Europe.

"This paper explains -- at least in part -- why some European populations, such as people from Sweden, are taller on average than others, such as people from Italy," Hirschhorn said.

The researchers were only able to detect this signature of evolution by using the results of recent genome-wide association studies by the GIANT consortium, which identified hundreds of different genetic variants that influence height.

What does it mean to be "obsessed" and what does it mean to give the Holocaust an appropriate place in our political and cultural consciousness?

I admit I was stunned in exploring this question to find no less than 272,000 Google hits for "obsessed with the Holocaust." And it's not just racist sites (including David Duke's) or anti-Zionist sites like Mondoweiss.

Increasingly the word "obsessed"?as "obsessed with the holocaust" or "holocaust obsessed"?has entered contemporary discourse, often used by Jews as an epithet to describe other Jews. It may have entered the mainstream as far back as the publication of Peter Novick's 1999 book The Holocaust in American Life, in which he accuses American Jews as a whole of exploiting the Holocaust in bad faith, either as a "victimization Olympics" or for political (primarily pro-Israel) purposes.

The term "holocaust-obsessed" appeared in The New Yorker in an article about Israeli politician Avraham Burg who, according to David Remnick, "describes the country in its current state as Holocaust obsessed. ..." Too much attention to the extermination of 6 million Jews oh so long ago, just because 6 million or so more are being threatened with exterminationist rhetoric today.

It's lately become a trope of novelists and memoirists who seek to show how much more sophisticated they've become about the whole thing.

Demonstrating that it has become a widely recognized shibboleth on both sides of the discourse over American Israeli relations, Jonathan Rosen, in his astute New York Times Book Review critique of Peter Beinart's Crisis in Zion offered a caustic assessment of those self-proclaimed enlightened moralists who accuse others of a "Holocaust-obsessed" mentality.

The movie is no triumph of storytelling, but it?s a fine example of colorful filmmaking. Though his last name is Bronson, Charlie is about as assertive as a bean bag, which may be part of his appeal for Annie. Her academic focus is nonviolent conflict resolution, so naturally she?s drawn to the most easygoing guy in the county.

The overture is ham-handed comedy, with too-cute comic bickering between the lovebirds and shrub-shredding automotive slapstick involving a visiting U.S. marshal (Tom Arnold) unable to keep his minivan on the road.

The opening scenes are so inept it seems unimaginable the film will get on track and tell us a tale. Soon enough, Charlie pulls the tarp off his hot-rodded 1967 Lincoln Continental to drive Annie to L.A. for her dream faculty job interview. That muscle car is as black as Charlie?s past, which resurfaces to transform their leisurely drive into a stuntman?s holiday.

Soon they?re at the head of a high-revving motorcade with the federal lawman, Annie?s stalkerish ex, two bumbling local cops and Charlie?s best-friend-turned-nemesis (Bradley Cooper) in hot pursuit. Charlie, it seems, has some history with the witness-protection program and bank robbery.

The film boasts several slumming stars in odd, juicy roles, with Kristin Chenoweth, Beau Bridges and Sean Hayes in pleasingly eccentric turns. Cooper, usually a suave guy, is the wildest and wooliest of all. He?s the sort of hair-trigger psycho who acts pacifist one moment and pistol-whips a bystander for purchasing inferior dog food the next.

Shepard, a gangly guy who?s cute for a comedian, makes Charlie an ongoing surprise. He?s more resourceful than we expect, and forever struggling to keep the inherent violence of the chase from escalating into something terminal. He and Bell ad-lib effortlessly. We see the playful chemistry that would keep them together even when parting would be the practical move.

Sharing director?s duties with David Palmer, Shepard sort of clobbers you with scenes. His favorites involve cars driving very fast, side by side, trading paint. This is ridiculous, but it?s sublimely ridiculous ? pure old-school stunt work. Cat meows theme to 'Game of Thrones'

You'll have to be a real cat lover -- or a real fan of "Game of Thrones" -- to get through nearly two minutes of Siamese cat Arya (apparently named after the younger Stark daughter in "Thrones") yowling through the theme to the award-winning HBO series.

But if you can stand the sound (the kitty appears to have the assistance of Auto-Tune), and the fast-cut editing that made it possible, you'll probably be purring by the end.

New NASA lander to help scientists study how Mars formed

CAPE CANAVERAL, Florida (Reuters) - NASA's Mars Curiosity rover is going to get some company.

The U.S. space agency on Monday selected a small Mars lander for a hotly contested small planetary science mission to launch in 2016. The point of the mission is to help figure out how Mars formed, information that scientists say will give them insight into how rocky bodies like the Earth were created.

Unlike Curiosity, a car-sized surface rover that landed on August 6 to search for habitats where microbial life could thrive on Mars, the new probe will be focused on what is happening deep in the planet's core.

The solar-powered lander, called InSight, will include a French-built seismometer to determine if Mars has "Marsquakes" and a thermometer to measure how much heat is coming from the planet's core, officials said.

"This is something that has interested the scientific community for many years," John Grunsfeld, NASA's associate administrator for science, told reporters during a conference call on Monday.

"Seismology is the standard method by which we've learned to understand the interior of the Earth and we have no such knowledge for Mars," Grunsfeld said.

While the lander will not be as elaborately outfitted as Curiosity, which has 10 instruments for chemical analysis and other studies, InSight will have a German-built drill that can penetrate 30 feet into the Martian crust, officials said.

The project competed against two other proposed missions for $425 million in NASA funding and a ride into space.

The other contenders were: a project to explore a liquid methane lake on Titan, the largest moon of Saturn; and a robotic hopper that would sprint around the surface of a comet measuring how sunlight changes the surface.

NASA's Jet Propulsion Laboratory in Pasadena, California, which is overseeing the Curiosity mission, will lead InSight.

The lander will be designed to last two years.

Six-year-old battling brain cancer meets country music star | Cancer ...

OWENSBORO, KY (WFIE) -

Owensboro?s Big O Music Fest drew big crowds, and served as the backdrop of a special?meeting between a little girl with brain cancer and a major country music star.

That little girl is six-year-old Harlie Bryant. Last year, her parents say she was diagnosed with a cancerous brain tumor following a weak eye exam.

Over the past year, her parents say she has been put through surgery and chemotherapy to reduce the size of the tumor, but for the time being, they say they just want her to enjoy her childhood.

Yesterday, that included getting to meet country music star, Blake Shelton.

The Handicapped Scuba Association (HSA) taught a scuba-diving lesson to pediatric rehabilitation patients on Saturday, Aug. 11 at Miller Children?s Hospital Long Beach (MCHLB), 2801 Atlantic Ave. The lesson took place in an indoor rehabilitation pool on the hospital campus.
HSA is an international nonprofit organization focused on improving the physical and social well-being of people with disabilities through the sport of scuba diving. Instructors Jan Tunnicliff and Denise Dowd introduced the scuba diving with a lesson on using an underwater breathing apparatus. Mariana Sena, a recreational therapist in the Pediatric Inpatient Rehabilitation department at MCHLB, also participated.
The rehabilitation department offers physical therapy, occupational therapy, speech therapy and recreational therapy. In addition to these services, they design unique and comprehensive treatment programs such as the scuba lesson. Past events included sailing with the US Sailing Center, flying around Long Beach with the California Flight Center and horseback riding with B&B Stables in Cerritos. ?Different children participate in the program,? Sena said. ?It depends what [the patient?s] level is. The most important [consideration] that is required is their level of cognitive abilities so they could comprehend the gist of what is expected of them.?
The scuba lesson is different from MCHLB?s other events in that the water allows patients with disabilities including spina bifida (a birth defect that involves the incomplete development of the spinal cord or its coverings), brain injuries, neuromuscular disorders and other conditions to move with less difficulty, boosting their confidence and self esteem, according to Sena. ?There is no gravity, so they are able to have more freedom,? Sena noted. ?Most of them have difficulty walking on land, and here they are able to exercise and walk in the water. It gives them a totally different experience that they normally wouldn?t have.?
Maria Gutierrez is the mother of 14-year-old Enrique, who participated in the scuba lesson. ?They first came into the pool area in their braces and wheelchairs,? she said. ?But when they are in the water, you don?t see (the braces and wheelchairs). They are on the same plane field.?
Enrique is diagnosed with VATER syndrome, a combination of birth defects. ?V? stands for abnormalities of vertebral or spine, ?A? for anal atresia, ?E? for esophageal atresia with tracheo-esophageal fistula and ?R? for Radial or Renal problems. When he was first given the invitation to participate in the scuba lesson, Enrique was very excited, according to Gutierrez. ?He had never done anything like scuba diving before,? Gutierrez said. ?He learned how to swim recently in our own pool? about three or four weeks ago. Perfect timing.? Gutierrez describes her son?s progressive actions as miracles. ?When I was told that he wasn?t going to be able to survive when he was born, and then that he would never be able to walk, I don?t think there are words that can describe every time he does something,? she explained. ?Years ago, I would never have believed this was possible.?
Sena described the overall event as ?a wonderful experience for the kids.? She added, ?It shows that if they really put their mind to it, their disability shouldn?t keep them from doing what most of us are able to do.?
