CHICAGO (Reuters) - Russell R. Wasendorf Sr., chief executive of Peregrine Financial Group, who was arrested earlier this month after confessing to bilking customers for 20 years, is accused of stealing something else: a rock and roll tune.

On Friday, attorneys for the 1970s rock band The Knack -- famous for its song "My Sharona" -- sent a cease and desist letter to Wasendorf and his now-shuttered Italian restaurant MyVerona in Cedar Falls, Iowa, to stop him from using a re-recording of the tune as part of the eatery's online advertising campaign.

The restaurant had used the song, with the chorus modified to "M-M-M-My Verona," for several years as a theme song on its web site and other online venues, according to local residents and former company employees.

Among other things, the song served as a soundtrack to a video montage shot inside the restaurant, including clips of a plate of wood-grilled beef tenderloin, hand-cut pasta and a glimpse of the restaurant's collection of more than 240 varieties of wine. As of Friday afternoon, two weeks after Wasendorf was arrested at an Iowa hospital, the video was still available on YouTube and the restaurant's web site.

Wasendorf never contacted the authors of the song or the copyright owners and did not pay for the right to use it commercially, according to a letter sent by an attorney representing Knack bandmates Berton Averre and Doug Fieger, the song's authors.

"The Composition is one of the most popular songs of all time, and companies pay our client significant sums for the right to obtain a license for the use of the composition," according to the letter, which noted that Wasendorf could face as much as $150,000 in statutory damages.

The public defender representing Wasendorf was not immediately available for comment.

The Commodity Futures Trading Commission has accused Wasendorf of misappropriating more than $200 million of his brokerage's customers' funds.

"All he had to do was pay us and send us a copy of the lyrics so we can OK them," Averre said. "We got bubkes. It's really outlandish, that someone in this day and age tried to get away with this."

Flu Cases From County Fair Traced to Pigs

THURSDAY, July 26 (HealthDay News) -- Four people attending an Indiana county fair this month came down with flu traced to pigs, U.S. health officials report.

This outbreak of influenza A (H3N2) brings the total number of people infected with this flu to 17 since last August, the U.S. Centers for Disease Control and Prevention said.

This strain of flu, commonly carried by swine, can infect humans who come into contact with infected animals. But transmission to humans has been rare, according to the agency.

"Transmission of the virus happens," said Dr. Michael Jhung, a medical officer in CDC's influenza division. "But if you think about the numbers, if you think about influenza in general, these are uncommon events."

These strains of flu have only a limited ability to be passed from person to person, Jhung said. So far, this strain only passes from one person to one other person, so it is not very contagious.

"What we worry about is this virus or any flu virus getting the ability to transmit efficiently from person to person," Jhung said. "If that happens, you get sustained transmission and we would be worried about that."

Because flu activity is unpredictable, the CDC keeps tabs on new strains and cases as they arise, to guard against widespread contagion, Jhung explained.

A previous case of this flu was seen in March, but these four new cases are the first reported since then, he said.

The report was published in the July 27 issue of the CDC's Morbidity and Mortality Weekly Report.

Genetic analysis confirmed that all those infected had the same flu. None of the four infected people needed hospitalization and all recovered, according to Jhung.

The flu's severity was about as bad as regular seasonal flu, he noted.

The four patients were either exhibiting pigs or were family members in close contact with the pigs.

To avoid contracting this flu, the CDC advises people to limit their contact with pigs and avoid contact with sick swine. People who have contact with these animals should take precautions such as washing their hands, not eating or drinking in areas with swine and controlling their cough.

Most flu starts in swine or birds and spreads to people. In 2009, a type of H1N1 flu from swine resulted in a worldwide pandemic.

Big tech stocks rally after early earnings reports ...

SAN FRANCISCO (AP) ? That wasn't so bad, after all.

That's the sentiment among investors as they digest last week's smorgasbord of quarterly results from technology companies that included Intel Corp., IBM Corp., Microsoft Corp. and Google Inc. Although reports from the industry bellwethers all featured some troubling signs, their performances indicate the technology sector is largely holding up, even as Europe's debt crisis undercuts sales and threatens to topple a still-shaky U.S. economy into another recession.

"What you are hearing now is a huge sigh of relief," said ISI Group analyst Brian Marshall.

As they exhaled, many investors latched on to Intel, IBM, Microsoft and Google. All four of their stocks ended last week higher than they began. That was good news for the Dow Jones industrial average, which also edged upward. The index includes computer chip maker Intel, corporate technology specialist IBM and software maker Microsoft in its basket of 30 stocks that are supposed to reflect the state of U.S. industry.

As a whole, the technology sector is in better shape than Wall Street envisioned. That's especially heartening amid signs that Europe's debt woes could cascade into a financial crisis similar to the 2008 meltdown in the U.S. that deepened the Great Recession. The technology-driven Nasdaq composite index ended last week 7 percent higher than where it stood at the beginning of June.

The rally could still lose steam if other major technology companies flop in their upcoming earnings reports for the three months spanning from April through June.

Apple Inc., which has ridden the success of the iPhone and iPad to become the world's most valuable company, is scheduled to release its quarterly financial results this week. Other major technology companies on this week's earnings calendar include: chip maker Texas Instruments Inc., computer disk-drive makers Western Digital Corp. and Seagate Technology PLC, business software maker SAP AG, data storage equipment maker EMC Corp. and business software maker VMware Inc.

EMC, VMware and SAP have already revealed their quarterly results either topped or matched analyst estimates, helping to propel their stocks higher in recent weeks. Seagate has said its quarterly revenue missed analysts' targets, but its stock is still slightly higher than before the warning.

Investors haven't been as sanguine about the pratfalls of other companies. Business software maker Informatica Corp., computer printer maker Lexmark International Inc. and chip maker Advanced Micro Devices Inc. have all been severely punished for earnings letdowns in their latest quarters. Since they issued warnings about their disappointing performances, their stocks have plunged by 18 percent to 33 percent.

AMD spooked investors late Thursday with a glum forecast that included a frank assessment of the personal computer industry, which has been slumping as more people surf the Web on smartphones and tablet computers.

"We expect macro headwinds will continue for the third quarter," AMD CEO Rory Read told analysts on conference call. "We also believe the PC industry may be resetting to a new baseline and that full-year industry growth estimates will be reduced."

Intel, AMD's much bigger rival, also experienced a slowdown in the second quarter and sees sluggish conditions persisting in the third quarter. Unlike AMD, though, Intel still produced second-quarter earnings above analyst projections and investors appear confident in the company's ability to manage its way through whatever difficulty might be ahead. The same appears to hold true for IBM, which raised its earnings guidance for the second half of the year, even though it expects Europe's weakened currency to decrease revenue slightly from last year.

The swing in currency rates also represents a drag on Google's revenue growth, but the Internet search leader is offsetting some of that by tweaking its technology to aim more online ads at Web surfers most likely to click on them. The additional clicks translate to more revenue for Google.

The shift away from PCs shaped Microsoft's redesign of the Windows operating system, which runs on most desktop and laptop computers. Microsoft has tailored Windows 8 so it can also power touch-based tablet computers, including a device called Surface that the software maker plans to release to compete against the iPad.

Investors have such high hopes for Windows 8 ?due to hit the market Oct. 26? that they have been betting Microsoft will end the year with a bang as consumers and businesses snap up new machines running on the revamped operating system. Not even last week's announcement of Microsoft's first quarterly loss in its 26-year history as a public company could dampen the good vibes that have been lifting Microsoft's stock. The loss stemmed from a $6.2 billion charge for a soured acquisition from five years ago. But it was an afterthought for investors as they gaze into the future and try to figure out what's ahead.

The age of fossil fuels has changed the oceans dramatically. What many might not know is that the oceans absorb about one-third of all human-caused carbon dioxide emissions. And while this has saved us from even more rapid climate change, few people realize the true effect this has had on our seas. The recent heat waves, droughts, floods and super derechos are only a fraction of the extreme weather we could expect to see if the oceans weren?t around to help us out.

The absorption of carbon dioxide from fossil fuels has substantially altered the ocean?s basic chemistry. In the hundred plus years since the Industrial Revolution, ocean waters have become, on average, 30 percent more acidic. Ocean acidification, or ?osteoporosis of the sea? as some are calling it, threatens animals like oysters, mussels, clams, corals and tiny marine snails called pteropods that use calcium carbonate to form their protective shells and skeletons. But it?s not only the small animals that are affected. Rising ocean acidity levels pose substantial threats to marine biodiversity, fisheries, food security and marine tourism. The last time similar changes in the ocean?s chemistry happened more than 200 million years ago, 95 percent of marine life went extinct.

The alarms are sounding. Last week, 2,600 top marine scientists signed a consensus statement urging immediate action to limit greenhouse gas emissions in order to save coral reefs and the people who depend on them. But time and again these warnings result in zero action, and the public is still largely unaware of the issue. Because we live on land and don?t experience these chemical changes directly, scientists have had difficulty illustrating what ocean acidification actually looks like ? until now.

Spirit AeroSystems estimates its insurance claim from an EF-3 tornado that tore through its Wichita plant April 14 at about $400?million.

The company took a $55?million charge, or 26 cents per share, related to expenses in the second quarter related to tornado damage, the company said Thursday.

Spirit also took a $10?million charge for fees related to its $1.2 billion in debt refinancing, which closed April 18.

The tornado knocked out power and water, broke gas lines, took production equipment off line and blew off roofs as winds of about 160 mph ripped through the site.

The storm damaged 40 buildings and scattered debris across the complex.

The storm hit Spirit about 10:45 p.m. April 14, while about 200 employees were on site.

They sought shelter as debris blew through the buildings. No one was hurt.

Words can?t describe what Spirit went through, Mike King, Spirit senior vice president and chief operating officer, said last month.

As they went through each building to assess damage, King said he was glad when a building was dark.

?That meant the building had a roof,? King said.

Employees and contractors worked around the clock to get production and operations resumed. Spirit was able to resume some shipments three days after the tornado hit.

Eight days after the storm, all 10,800 Wichita employees were back at work.

Now, temporary fixes that were made to allow the resumption of work need to be replaced with permanent repairs.

Spirit is working with its insurers to determine the applicable deductibles related to property damage and expenses related to the tornado, company officials said.

The costs will be recorded as a severe weather event, and will be excluded from program cost of sales, they said.

Additional expenses will be recognized in future periods as they are incurred.

Offsetting credits will be recognized in future periods as insurance recoveries are confirmed, the company said.

It's the film's attempt at a conventional, big budget finale, with a big prop(Think H.G. Wells)...that trips it up.

"Safety" can't sustain its own offbeat energy. By the end, even Aubrey Plaza would roll her eyes at it.

Neatly, the script embarks on one journey while dangling the possibility of another: the prospect of taking a sudden leap from comic reality into the realm of pure imagination.

"Safety Not Guaranteed" is most vibrant and vital at its edges, in the way that the characters interact with each other while waiting for something to happen.

It's brisk and assured and never begs the audience's indulgence. No time is wasted. The movie is, at every moment, either funny or pushing the story forward, or both.

The film is modest but skillful and heartfelt, spiced just so by Plaza and company.

The characters are off-kilter and even weird, but watching them one senses their strange behavior occurs because of who they are, not because they're putting on a performance.

So good you're not going to care whether his time machine works or not.

'Safety Not Guaranteed' is a little comedy that makes the world safe for personal ads.

Safety Not Guaranteed is an indie flight of fancy. It's fresh and imaginative. Its best moments are when it is grounded in the absurdity and whimsy of the human condition.

The superbly-balanced tone of this sweet and sour outsider-romance is the real star of [Trevorrow's] feature debut, though breakout turns by on-the-cusp players Audrey Plaza and Jake M Johnson add to the film's warm and wondrous sense of discovery.

It is an offbeat charmer that is fun and engaging from a storytelling standpoint, but one that also brings a surprisingly rich emotional payoff.

Safety Not Guaranteed is droll and hilarious, but there isn't a cheap laugh in it, and the ending is so perfect it sends you soaring.

Unlike time travel or jet-setting, "Safety Not Guaranteed" shows that making movies can still be more about the journey than the destination. Whether or not you have first-class tickets.

"Safety Not Guaranteed" is eccentric enough to get mistaken for an uplifting fantasy, but it's Plaza who belongs in the penthouse.

Hope is a powerful thing and Safety Not Guaranteed delivers in its tale of longing, deliverance and connection during the here and now.

An intriguing yet erratic effort...

Less of a philosophical argument and more of a character piece driven deep into the heart by Duplass and Plaza.

Have you ever wondered what mumblecore sci-fi would look like? Wonder no more.

Rather than trying to beat Hollywood at its own game of high-tech gadgets and weaponry, director Colin Trevorrow and writer Derek Connolly achieve a sly mix of the insane and the mundane.

A character-driven piece about regret and true partnership - our basic, primal need for someone to take the journey with us even if safety is not guaranteed.

Aubrey Plaza is the best thing about this iffy mock-sci-fi doohickey.

As a hipster rom-com about people trying to shake off their pasts to make present-day connections, it's pretty satisfying.
