Japan industrial output down on weak export demand

(AP) ? Weaker than expected factory production in Japan has underscored the fragility of its economic recovery as growth throughout Asia slows.

Softening demand for exports led to the first decline in industrial production in the world's third-largest economy in three months, the government said Friday, though it reported modest improvements in employment and consumer confidence.

The news cast a pall over share markets in Asia, already jittery over the pending release Sunday of Chinese economic indicators. The Nikkei 225 index in Tokyo fell 0.3 percent to 10,083.56.

The 1.2 percent decline in industrial output in February was worse than expected and reflected lagging output in the transport equipment, electronics components and machinery industries. Production of cell phones, large passenger cars and liquid crystal devices also weakened, the government said.

"Whether this recent trend will be sustained will depend on the extent of the recovery in Asia," said Masayuki Kichikawa, an economist at Bank of America-Merrill Lynch. "The uncertainty over Chinese data is a very important factor."

The devastating tsunami in March last year ? and a shift of manufacturing overseas to cut costs and reduce damage caused by the strong yen ? plunged Japan's trade account into the red in 2011 for the first time since 1980.

Slowing growth in powerhouse China, the debt crisis in Europe and continued frailty in the U.S. economy have further bit into demand for exports, which remains the strongest driver of growth for Japan.

Despite February's relatively weak number, output is forecast to rise 2.6 percent in March and 0.7 percent in April, as growth accelerates due to a pick up in rebuilding of northeastern regions devastated by last year's disasters.

Kichikawa said he expects the economy to "bottom out" in the second quarter of the year, boosted by strengthening demand for industrial materials such as steel, nonferrous metals and chemicals.

"We think production in Japan is on the uptrend, mainly due to reconstruction demand," he said.

Japan's economy shrank at an annual pace of 2.3 percent in the fourth quarter, also hit by slowing public investment due to political bickering that delayed parliamentary approval for a 12 trillion yen ($156 billion) extra budget for tsunami reconstruction.

The economy contracted last year by 0.9 percent from 2010, when GDP grew a robust 4.4 percent. In 2009, the economy shrank 5.5 percent.

In its latest economic assessment, however, the Organization of Economic Cooperation and Development forecast that Japan's growth would lead that of other major industrial economies in the first quarter, at 3.4 percent.

In other data for February, Japan's consumer price index showed a stronger than expected increase in February of 0.3 percent from the year before, to 99.8. It was up 0.2 percent from January.

Forecasts had been for virtually no change in the index.

Rising costs for fuel and food were the main factors pushing prices higher, the Statistics Bureau reported.

Although rising crude oil prices threaten to further push production prices higher, slight gains in inflation are viewed as a positive for an economy that has been wrestling for years with deflation, or falling prices, which can be a drag on economic growth.

Meanwhile, unemployment fell in February, to 4.5 percent from 4.6 percent in January.

The Ministry of Health, Labor and Welfare reported that the ratio of job offers to job seekers rose to 0.75 in February, up from 0.73 in January. It was the highest figure since November 2008, the ministry said.

Consumer confidence also rose, reflected in a 3.5 percent uptick in retail sales, the largest year-on-year gain since August 2010, the trade ministry reported Thursday.

Demand was also boosted by government subsidies for car purchases, which rose 21.4 percent from a year earlier in February, after jumping 24 percent in January.

Abby Mims | The Arc of My Redemption | The Nervous Breakdown

By the fall of 2010, my mother had been sick for a year and a half, already outliving the parameters of her terminal diagnosis. I had been living with my parents for a year by then, and my days were overflowing with her illness, creating a heartbreaking, beautiful, heightened, stressful and joyful existence, if an insular one. To cope and try to make sense of things, I attempted to write about it, but? it wasn?t really working.? This was the most important thing I?d ever experienced in my life, and I felt it should be my next book.? But nothing was taking shape. Aside from a few inspired blog posts, I was failing miserably.

That October, in spite of myself, I decided to go to a literary festival in Portland, as my friend Sarah was in town and we had attended it together for two years running. She was always jazzed by it, feeding off the creative buzz, the possibility of publishing, listening to writers read.? I wanted to be similarly enthused, and in moments I was, but the year before I had spent much of the conference feeling like a fraud and hating myself for the fact that my memoir hadn?t sold. It had gone out in 2008, ?the worst time in the history of publishing,? which was part of the problem. Then there was the fact that many editors hadn?t been clear on ?the arc of the the writer?s redemption,? by which they meant my arc, my redemption.

Don?t fret if you?ve never heard of this arc; it?s not a thing that exists in real life. It exists on the page or the screen, and in memoir, it is supposed to be the narrative journey that your protagonist takes (in this case, me) from the point where you introduce he/she/me to readers to the place in time where the book reaches its end. Because life is fluid and weird and fucked-up, it can be very difficult to pinpoint these exact moments in time, while simultaneously trying to explain what it is he/she/me has learned from point A to point B.

My arc went something like this: my sister had cancer, I helped take care of her, she survived when she shouldn?t have, and, in the aftermath of her remission, she fell in love while I fell into the deepest depression of my life and our relationship came almost completely undone.

I did my best to capture these events in the book, but as time passed, I realized that the editors had a point. It was two years later, and I was still struggling to figure out what it all meant. Now, too, my mother was dying, which ripped any semblance of an arc into indecipherable bits.

When Sarah arrived, she was hyped up, talking a mile a minute about her writing, her book plans, her new job, and her move from the East to the West coast.? Everything was new for her that day, everything was possible. Her life was moving fast, and I don?t think she took a breath all afternoon. Mine felt all the more stuck in neutral for her enthusiasm. She had two books to her credit, with plans to write two more while working forty hours a week, while teaching some online classes as well.? I was jealous not only of her enthusiasm, but her optimism and energy; for me, getting up before 10 had lately become a serious challenge.

Sarah asked about my mom as she always did, but when I?d answer, she seemed perpetually distracted, unable to focus. As we wandered between small press booths and Northwest souvenir kitsch, I tried to remember why, given the state of my life and writing, I had even bothered to come.? The answer seemed simple:? I had come to hang out with Sarah, a friend with whom I?d always felt an easy and comfortable bond?but not today.? It was disappointing to feel disconnected from someone I had known for years, but this was part of what was happening to me as my mother?s illness wore on. The gap felt so wide on some days that I couldn?t remember what my life had been like before she was sick?what I did, what I talked about, what was important.

I had also come to the festival with the naive hope of having another Ethan Canin Experience. He had redeemed the event for me the year before, saved me from bludgeoning myself to death with the nearest book.? He is one of my favorite writers, and if you haven?t read Emperor of the Air, stop reading this and go read that.? Sarah and I had stumbled into his panel appearance and accosted him after he spoke.? I gave him the Cliff?s Notes version of my story?my difficult graduate school experience, the failed memoir, all the freaking cancer?and he told me that sometimes, in order to write, you have to be told no, you have to be fighting against something. Then he asked for our cards and said: ?Abby Mims. Now that?s a writer?s name. You have to be a writer.? A few days later, I sent him some links to things I had written about my mom.? He responded, saying, ?Beautiful. You should really keep doing this writing thing, because you?re very good at it.? I walked on air for at least a week.

Now, I took a deep breath and attempted to regroup, trying to function like a normal member of society, instigating conversations with Sarah that didn?t involve cancer, death or dying. I brought up authors we both loved, great places in Portland to get cupcakes, the Northwest rain. This helped. What also helped was seeing Steve Almond speak on a panel about humor in writing. Watching him rant and laugh made me feel almost human again. Afterwards, we went back to walking the main convention floor, where she stopped to chat with the local writers and publishers she knew. She knew a lot of them, and always made a point to introduce me as they talked, mentioned that I was a writer too.

?Oh,? they would say politely, ?what do you write?? And I would mumble something about short stories and essays. Once I think I mimed typing in the air in front of me before I fell silent.? Another year had passed without anything to show for my time. I was all the more clear that I was falling catastrophically behind, six years out of graduate school and not a trace of a book to my name. It was dawning on me as a writer, there is no tiny, smiling Ethan Canin to hold in your pocket at times like these?there is only your own vague sense of purpose and the hope that what you are experiencing will somehow eventually show up on the page.

Then, we ran into a jerk I dated whom we both knew, who once called memoir ?so-much navel gazing.? I couldn?t even muster a smile. Sarah chatted with him while I stood silent next to his roommate.? Attempting conversation, said roommate asked about my pug.

?He died,? I said. And he had, a few months after my mother?s diagnosis. The day was becoming a waking nightmare.? ?I think I?m about done,? I said to Sarah when we broke away from them.? I felt like I wasn?t quite in my body anymore, that I was hovering just above it, watching from a few feet in the air.

?Really?? she said. ?Well, I?ll? just to do one more quick lap.?

I said okay and followed her to the main floor. She stopped at a booth manned by three very nice looking women in their twenties, the quintessential natural Portland types. They were there representing some kind of? grant program.? ?Do you want to spin the Wheel of Conversation?? they chirped.

?Of course!? said Sarah.

I took a step back, pretended to browse some vintage postcards. I did not want to spin the Wheel of Conversation.? I wanted to curl up on the industrial carpet and sleep for a week. I was close enough to hear the question she landed on: ?What?s the best thing you?ve seen this week?? I don?t remember what her answer was, just that it was animated and detailed.? I realized I couldn?t take it anymore, that I had to get out of there.

Sarah was on her way to the next booth, and in trying to catch up with her, I caught the eye of one of the Wheel Girls.? ?Do you want to spin the Wheel of Conversation?? she chirped.? I don?t know why I said yes. I think it came down to a desire to please coupled with how earnest and kind she looked.? I spun and got this question: ?Who are your people??

I was stunned, at a total loss. I?m not sure I?ve ever been more inarticulate in my life. ?My people?? I said. ?My sister had cancer and now my mom has cancer and I?m trying to write about it, but, well, my book didn?t sell ?? I lost my train of thought. I stared at them, willing words.

They blinked, straightened in their chairs, waited for more. Awkward seconds passed. The blond in the middle said,? ?Well, it sounds like your people are writers. Or maybe people with cancer??

?Sure,? I whispered.

?Well,? she said, ?we?re taking submissions for the next issue of our magazine, and the theme is ?Fail.? I mean, not all failure is bad, right? And it sounds like you might have some interesting things to say about the topic.?

I took the magazine, my eyes already blurred. I caught up with Sarah, gave her a quick hug and bolted towards the exit. I lost it on the way to the elevator, then sat in my car sobbing and hyperventilating, the sadness and frustration I had been repressing for months spilling out. Then I cried all the way back to my parent?s house.

When I came through the front door, my stepfather was making dinner and my mother was sitting in her wheelchair at the edge of the kitchen island, trying unsuccessfully to watch him without correcting his cooking technique. I had tried to compose myself before going inside?not that I?ve ever been able to hide my feelings from my mom. I didn?t like her to see me upset about the current situation.? She felt guilty enough that I was helping take care of her.

?How was the literary thing?? she said.

?Horrid, terrible,? I said, and then started to cry again. I told them how far behind I felt, how utterly lost. They listened as they always do; they said they were so sorry.

?It?s not your fault,? I said. ?I mean, at this point, it just feels like the universe is fucking with me. Who are my people? Jesus Christ.?

They were both quiet for a few minutes, as was I. ?Your people are people who have lost someone,? my mother said, sighing. ?I?m afraid that?s just the truth.?

It?s not always easy to have a mother so wise, but there it is. I had a particularly crystallized moment when I found out she had a brain tumor, but didn?t yet know it was terminal. I started to count the people I knew, close friends and recent acquaintances, all about my age (36), who had lost their mothers: Dennis, Lisa, Al, Diana, Katie, Corey, Krissy, Jeff, and Cheryl, and the list just kept growing. I knew then she was going to die.

?But the rest of them, don?t they understand?? I said. ?I?m doing really important work here. It?s just not anything they can see. There is no husband, no family, no book, no career.? I lost it again, and my mom held out her good hand to me. I hugged her for a very long time.

And this, it would seem, is the arc of my redemption?or a piece of it, anyway?as it might appear on the page.? It was then I understood that living through my mom?s illness was changing who I was on a cellular level, blowing me apart and putting me back together so profoundly that of course I hadn?t yet been able to put it down in writing. I had no choice but to wait until the words came, until my mind could assemble the facts into some kind of palpable story. I had to let go of everything else, including the idea that even if there ever was a tiny, smiling Ethan Canin for me to carry around, it would really help anything, anyway. A writer?s faith is an almost entirely internal mechanism. However, I am lucky enough to have my mother?s voice with me when doubt creeps in, as it inevitably does from time to time.

Junior Dos Santos is Fully Prepared to Defend His Title

Now that Junior dos Santos has captured the UFC heavyweight title, don't expect him to give it up without a fight.

The heavy-handed Brazilian knocked out former champ Cain Velasquez in just over a minute this past November on the UFC's inaugural FOX show to capture the belt, but has been sidelined since rehabbing a knee injury. Dos Santos is now on deck to attempt his first title defense against former Strikeforce heavyweight kingpin Alistair Overeem.

The two are to meet in the main event of the all-heavyweight UFC 146 fight card this May and dos Santos is confident that the title won't be changing hands on that night.

"My dream was to become the champion," dos Santos said. "The minute Dana strapped that belt around my waist, my dream got bigger. I'm not here to be a one or two-defense champion; I'm here to stay. On May 26, there's going to be a heavyweight striking war and someone is getting knocked out."

UFC 146 is expected to take place at the MGM Grand Garden Arena in Las Vegas, Nevada and will feature five high-level heavyweight bouts on the main card.

Prostate cancer is a malignant or carcenogenic growth composed of cells from the prostate gland. The expansion generally occurs steadily and remains limited to the glands for several years and during this period there are minimal symptoms.

The reasons for prostate cancer are still not known but the predisposing factors include advancing age, genetics, hormonal influences and such environmental elements as poisons, chemicals and commercial products.

There are four stages of prostate cancer determined by its advancement or spread throughout the body. Stage IV prostate cancer also known as stage T4 using the TMN staging system which uses the letters T, N, and M to signal Tumor, Nodes and Metastasis.

It is the most advanced stage. At this point the cancer has spread outside the prostrate to distant locations in the body. The bones are a favored site of prostate cancer spread. This stage can be further subdivided into two subcategories depending on the limits of spread of the cancer. These stages are D1 and D2.

In D1 the cancer has spread to the extent of obstructing the tubes coming from the kidneys to the bladder, it has also spread to the pelvic lymph nodes or both cases may happen. In D2 the cancer has spread to the lymph nodes outside the pelvic area, the bones or other distant parts of the body.

The signs and problems at this point in time, include a burning sensation during urination,blood in the pee, fatigue, malaise, weight loss, abdominal pains, jaundice can be noted, chest discomfort and coughing happening due cancer spread to the lungs. The presence of these symptoms is not diagnosing of the condition so appropriate medical tests should be done to confirm the sickness.

At this point it is often tricky to cure the disease but there are many therapies which can on occasion be done to enhance the quality of life and reduce the suffering of the patients.

Happy Feet, Healthy You: How Your Diet Can Affect The Balance ...

feet on carpetLet?s face it, our diets as humans affect so much of who we are and how we live, but did you ever stop to think about how the food that you?re putting in your mouth affects the exact opposite end of your body ? your feet?

Yes, believe it or not, your nutrition can have a massive impact on the health of your feet. Here are some things you may not know about your health and the health of your feet, and some ways to help improve both.

Weight

Think about your body weight. You?re constantly adjusting your diet as you see your weight go up and down, but have you ever considered how your weight affects your feet?

The feet often get forgotten about because they?re so far down the body, but carrying around too much body weight can put excessive amounts of pressure on those little guys. And when you rely on them for so much throughout your day (think about it ? your feet are your only source of support for your entire body), the excess weight and pressure could really be holding you down, literally.

Extra weight on your feet can eventually lead to osteoarthritis, and an additional 25 pounds carried can cause even more problems in your feet and ankles, so eating a well-balanced, healthy diet is essential to both weight loss and foot health.

Sugar

Diets that are high in sugar only tend to do bad things to the human body, including increasing levels of certain chemicals in your body that lead to inflammation. And it?s not at all uncommon for that inflammation to develop in the feet.

Inflammation in the feet can be incredibly painful and can even potentially cause plantar fasciitis, an injury that affects the large band of tissue that runs through the arch of your foot.

Baked goods and junk foods contain tons of sugar and tons of trans fats, and the trans fats also promote inflammation in the body. Sweets and candies cause your blood sugar to raise quickly and dramatically, which, again, can essentially cause the feet to swell.

Inflammation in the feet can be incredibly painful and difficult to bring down, so your best bet is to lower the amount of sugar consumed on a daily basis and pay close attention to any foods that you think may cause your feet to swell.

Sodium

A diet too sweet can cause inflammation in the feet, but so can a diet too rich in sodium. Sodium is an electrolyte that your body uses to convey electrical impulse throughout your body to insure its proper functioning, and usually pools around your extremities when consumed in extreme amounts.

When you consume too much sodium, you?ll feel thirsty, and therefore end up drinking more water to try to rid yourself of the feeling. The water immediately enters your body and travels to the places where there are the highest levels of sodium (namely your feet, ankles and hands).

Your extremities then hold onto the water to combat the high levels of sodium concentrated in them, causing the extremities to swell. And again, swelling only leads to problems.

Try restricting the amount of sodium in your diet ? while small amounts of it are necessary for survival and water retention, too much of it causes your body to retain too much water and begin to swell.

When it?s your feet and ankles that are swelling, your circulation can be decreased and as a result, you?ll experience numbness and tingling, neither of which are very pleasant feelings.

Overall, pain in the feet causes pain throughout the rest of the body, as well. The feet are the support system of the human body, and when everything on top crumbles, the support will eventually crumble, too. Treat your feet well by eating a healthy diet and maintaining a healthy weight and you may never have to experience foot pain.

And by taking care of your feet, you, in turn, will also feel better. You?ll feel healthier, happier and able to be more active with a healthy pair of feet attached to your body.

PFT: Peyton saga doesn't surprise Alex Smith

The Dolphins under owner Stephen Ross not long ago seemed like a large man with a big bat who simply couldn?t connect on a high and tight fastball. ?Now, perhaps Ross and the Dolphins are a little kid swinging a cracked broom at a pi?ata that is hanging too high for him to reach.

Free-agent quarterback Matt Flynn, who set on January 1 a Packers franchise record with 480 passing yards, has agreed to terms with the Seahawks, according to Adam Schefter of ESPN.

Schefter reports that Flynn will sign a three-year deal worth up to $26 million, with $10 million guaranteed. ?Tom Silverstein of the Milwaukee Journal Sentinel reports that the deal has a base value of $19 million.

The maximum annual value of less than $9 million reflects some skepticism regarding Flynn?s ability to get it done as the week-in, week-out starting quarterback. ?And the ?up to? means that the deal includes incentive payments, likely based on whether he plays.

There?s no guarantee he will. ?Tarvaris Jackson has a year as the starter, and six total years in the system that Seahawks offensive coordinator Darrell Bevell uses.

And so it?ll be harder for Flynn to get to the field in Seattle than it would have been in Miami. ?And yet he chose that over a reunion with former Packers offensive coordinator Joe Philbin, now the head coach wih the Dolphins.

Maybe the Dolphins really did lowball Flynn, thinking he?d take less to be with Philbin. ?Maybe Flynn, like Jim Harbaugh and Jeff Fisher and Peyton Manning, decided not to be a Dolphin.

Either way, it puts the Dolphins in even more of a bind. ?Their best bet now will be to acquire the starter that gets bumped by Peyton Manning: ?Alex Smith, Tim Tebow, or Matt Hasselbeck.

Or maybe to make a Hail Mary effort to get back into the Peyton chase.

New Federal Court judgment reminds why care should be taken ...

The Federal Court has ruled that a US woman pay damages of $147,000 plus costs for her unjustified threats of legal action against an Australian indigenous artist and his agent.

The woman had assisted the artist in making some film footage for which she was paid. She then claimed she owned copyright in the footage and through a US law firm, sent threatening letters to the artist and his agent, a gallery owner.

The threats did not take into account the Australian law and no legal action was commenced. In determining the amount of damages the court took into account evidence that the film trailer was removed from public exhibition, which meant that the artist lost the opportunity to exploit the work at an advantageous time.

Janet Tavakoli: Today's Most Important Finance Story: Lan T. Pham, Ph.D., Told the CBO the Truth About Mortgage "Securities" and Was Fired For It

Every day I read the Wall Street Journal, the Financial Times, the New York Times and Handelsblatt. Then I skim other finance papers online. I also read several finance blogs. Each day I ask myself what is the most important news story of the day. Usually I vote for one that has the chance of making me and my clients some money, or avoiding a loss or shorting to make money... you get the idea, it's usually all about the Benjamins. But sometimes the most important story is one about the integrity -- or lack of integrity -- in our financial system.

Part of our financial system is the "support" network that surrounds it. The Congressional Budget Office (CBO) is one of the links in that network. Today's top story involves the CBO and one of its former employees, Lan T. Pham, Ph.D., fired after writing about growing foreclosure problems due to robo-signing and the fact that the ownership of mortgage loans isn't clear due to the shortcuts taken to serve the "securitization" process. This poses fatal flaws for securitization, since ownership of the loans is in doubt. Moreover, this has implications for systemic risk in the financial system.

This knowledge isn't unique or new. What is new is that Dr. Pham brought this forward to the CBO and apparently this information is being suppressed and denied by the CBO and in congressional reports.

I didn't read her story in mainstream media. I read it at ZeroHedge.com, and now you are reading about it at the Huffington Post. ZeroHedge is run by Tyler Durden, the pseudonym used by several anonymous contributing writers. I doubt that any of them is Brad Pitt, who played this character in Fight Club, but I wouldn't want to underestimate Mr. Pitt, so I apologize in advance if I'm wrong in that assumption. More on that topic later.

One wades into this fight club knowing the sparring partners have an agenda. Caveat lector. But that goes for "mainstream media" in spades, too, so this shouldn't deter you. The overwhelming value of this site is that it airs different viewpoints--that's what makes a market -- and it sometimes brings forward unique stories one cannot find anywhere else. Americain, bemoaned KPMG's publication of the names, addresses and debt holdings of customers harmed by MF Global's crimes and subsequent bankruptcy. Retail customers seem to be prey.

We human beings often underestimate each other and we stereotype too much. When people rouse themselves they do amazing things. If the proverbial Sleeping Giant reawakens in the United States, we can see rapid positive change.

Many people don't remember a time when everyone could smoke anywhere they pleased and it was the people who asked them to extinguish their cigarettes that were viewed as jerks. Today the situation is quite different in the United States. It took a while, but the truth about the risks came out and we as a nation changed our habits. The same thing can happen in finance.

My response to Jesse was that one should never underestimate prey, and one shouldn't even assume they are prey. The film The Naked Prey is astonishing on many levels. (AP) ? A defendant in a family dispute was being held without bail on a murder charge after police say he fatally shot an elderly woman as she tried to run inside a Texas courthouse, setting off a shootout with law enforcement officers that briefly became a hostage situation.

Bartholomew Granger, 41, was also accused of wounding three other people, including a daughter authorities said he ran over with a pickup truck while he tried to escape. He was being held at a jail after being treated at a hospital following his arrest.

The woman killed, Minnie Ray Seabolt, 79, of Deweyville, Texas, appeared to be an innocent bystander, Jefferson County Sheriff Mitch Woods said. Granger's daughter remained hospitalized in critical condition, authorities said. The daughter's mother and the third person injured were treated at the hospital and released.

Granger was outside the Jefferson County Courthouse in Beaumont on Wednesday before the continuation of his trial, grabbed a gun from his truck and began shooting, authorities said. The woman was fatally struck as she tried to run into the courthouse, while Granger's daughter and another bystander fell to the ground.

Several law enforcement officers returned fire as the courthouse about 80 miles east of Houston went on lockdown.

"It was crazy," said Beaumont Police Chief Jimmy Singletary. "He was shooting. Our guys were shooting."

Police say Granger was firing from his truck and then ran over his daughter as he drove away. He went about three blocks before abandoning his truck in the middle of the street then taking hostages in a nearby construction business, police said.

Once inside, Granger spoke by phone to police and told them he was wounded. He eventually surrendered and was taken to the hospital.

Granger's attorney, Rife Kimler, said Granger's trial had begun this week and his daughter, 20, had testified against him Tuesday afternoon. She had been scheduled to be cross-examined by Kimler on Wednesday afternoon, the attorney said.

Kimler said the ongoing case was emotional, but he thought the trial had been going reasonably well.

"I didn't have him on my list of dangerous ones," Kimler said of Granger. "I've been doing this 21 years, and the ones I think are dangerous are in a file in my head. He wasn't in that file."

In separate court filings, Granger hinted at the emotional strain of his ongoing court battle. Two years ago, Granger sued the cities of Beaumont and Houston, their police departments and the two surrounding counties. Granger and three other family members sought compensation for the mental anguish caused by the allegations.

Granger complained in one filing of an "unprovoked brutal attack" against his family.

"This insurrection has caused heavy financial burden and hardship upon our family and extreme psychological damage to the Granger family," he said. "We may never (trust) the police again."

A federal judge dismissed the civil suit in December.

A pickup truck riddled with at least a dozen bullet holes remained in the middle of the street Wednesday afternoon.

James Gibson, one of the owners of Richard Construction, said about 50 to 60 employees were inside when the gunman entered. An assault rifle believed to belong to the gunman remained in the building, Gibson said.

Authorities said workers trapped inside the building helped to disarm Granger and let SWAT team officers inside.

"We understand hostages took advantage of the individual when he was semiconscious," Singletary said. "They refused to be victims."

Judge Larry Gist, whose office is across the street from the main courthouse building, said there was "pandemonium" as law enforcement flooded the scene as soon as the shots rang out.

Ricky Gandy said he went to the window of his office at LJA Engineering, which overlooks the parking lot next to the Beaumont Police department, after hearing a "pop, pop, pop."

He saw police shooting at a pickup truck as it came out of the parking lot, but the driver "never really got in a hurry."

"Once it started, it was kind of like the Fourth of July," Gandy added. "Several shots, I imagine, I'm guessing at least 30 shots all together."
