Authorities say 8 dead in Texas vehicle crash

ANNONA, Texas (AP) ? Texas authorities say eight people, including a mother and her three children, have been killed in a fiery, two-vehicle crash in Texas.

Trooper Sylvia Jennings with the Texas Department of Public Safety says a car traveling eastbound on U.S. 82 in Annona in East Texas crossed the center line and struck a westbound car driven by Sonia de la Torre of Annona. She and her 8-year-old daughter Erica, 6-year-old son Saul Jr. and 10-month-old son Eric all died.

Eric Wright and Curtis Derelle Sanders of Compton, California, who were in the eastbound car, were also killed. Two other people in their car also died.

Authorities say a passer-by discovered the cars in flames. Jennings says there were no witnesses.

Annona is about 150 miles (242 kilometers) northeast of Dallas.

NFL: Shoulder discomfort limits Tom Brady at practice but New Enland Patriots quarterback is expected to play Sunday against Buffalo Bills

Tom Brady participated in practice Thursday on a limited basis because of a left shoulder injury.

The New England quarterback had missed Wednesday's session, but the team said his absence was not injury-related.

Comcast SportsNet reported that same day Brady had X-rays to check for a separated left shoulder and was told he was "all set." Patriots spokesman Stacey James said Thursday: "If there was an injury then it would be on the injury report."

Brady was listed on Thursday's report as having participated on a limited basis with the shoulder injury. He's expected to play Sunday for the Patriots, who can lock up home-field advantage throughout the AFC playoffs with a win or tie against Buffalo. Brady landed on his shoulder with 1:40 left Saturday when he was tackled by Kevin Burnett in a 27-24 win over Miami.

Broncos: Safety Brian Dawkins watched practice from the sideline, unable to participate for a second day because of a neck injury that has left him questionable for Sunday's game against Kansas City. He's been sidelined for all but one quarter in the last two weeks, when Denver has given up 40 and 41 points in losses to Buffalo and New England. Coach John Fox described Dawkins' availability as day to day.

Cowboys: With tape still wrapped around his bruised throwing hand after practice, quarterback Tony Romo insists he'll be ready to play Sunday against the New York Giants. "Each day it's getting a

little bit better," he said. "We'll be good to go this weekend." Romo wore the protective wrap on his swollen right hand, the one he banged on a defender's helmet on the opening series Saturday against Philadelphia. The Cowboys-Giants game will decide the NFC East title.

Giants: Defensive end Osi Umenyiora is optimistic but uncertain about his status for Sunday against Dallas. He's missed the past four games with a high ankle sprain but has practiced on a limited basis this week.

Steelers: Quarterback Ben Roethlisberger doesn't want his sprained left ankle to keep him out of the regular-season finale Sunday against Cleveland. "As long as I can deal with pain, I'll be out there," he said. Roethlisberger, who sat out the Steelers' win Saturday against St. Louis, fully participated in practice again. He said the ankle, sprained Dec. 8 against the Browns, was "a little sore."

Vikings: Running back Adrian Peterson has scheduled surgery to repair his left knee. Dr. James Andrews will perform the operation Friday in Birmingham, Ala., six days after Peterson tore the anterior cruciate and medial collateral ligaments in his knee against Washington. The Vikings have said they expect him to be ready for next year's opener.

Saints: Running back Pierre Thomas was fined $7,500 for a touchdown celebration in which he placed a bow on a football and gave it to a fan against Atlanta on Monday night. He also violated NFL policies by wearing Christmas-themed green-and-red tape on his Saints uniform, and his fine for that was $5,000.

The Future of New Jersey

SUNDAY
Energy: New Jersey?s energy future has something for everybody ? including controversy ? as state officials advance plans to nourish the clean energy market but also rely more on cheap and plentiful natural gas.
MONDAY
New Jersey
?s cities: The challenge for New Jersey?s cities is to capitalize on the fact they?re virtually blank slates, allowing for towns to redefine themselves.
TUESDAY
Transportation: Federal money, or the lack of it, will determine the course of transportation improvements and maintenance during the next decade. And the outlook for more money coming from Washington is pessimistic at best.
TODAY
Business innovation: A transformation is underway in New Jersey in the aftermath of a recession that cost the state 265,000 jobs, or 6.5 percent of its employment. Experts think research companies can help jump-start the sluggish recovery.
THURSDAY
Sustainability: Individuals and organizations are embracing sustainability, say New Jersey's environmental leaders, but but we have yet to institutionalize that commitment in law.
FRIDAY
Agriculture: High land prices and ubiquitous development combine to create a perfect marriage in New Jersey: small farms that grow specialized crops and lots of customers. But to be profitable, farmers have to woo customers into buying directly at their farms.
SATURDAY
Education: Public-private partnerships and charter schools are among the initiatives that could radically change the face of public education in New Jersey.
SUNDAY, JAN. 1
The shore: The Jersey Shore area can expect growth and more flooding in the not-so-distant future, experts say, a hazardous mix that can lead to increased property damage and storm water pollution.
MONDAY, JAN. 2
Gaming: Policy makers are struggling to find the right medicine for New Jersey?s ailing horse racing and casino industries. Legalized sports betting may be on the horizon, but the one thing that some experts say could save racetracks ? slot machines ? is still a non-starter with Gov. Chris Christie.
TUESDAY, JAN. 3
Population trends: Baby boomers reach retirement age, facing economic uncertainty they may not have anticipated, and their generation is finally outnumbered by their children. Foreign-born residents continue to drive growth, particularly Hispanics.

Editor?s note: With New Jersey facing a crucial period in which its future will be decided, New Jersey Press Media newspapers have taken a hard look at a number of areas where the Garden State will be experiencing significant change. For this 10-part series, we interviewed experts, local difference-makers and entrepreneurs about what New Jersey will look like and what it could or should look like.

iPad 3 To Come Early 2012 With Better Screen And Battery

Apple could release two versions of its iPad 3 and we could be seeing the tablet a soon as late January according to new reports from the far east.

The reports come from Korean publication Digitimes who has spoken to those loose-lipped supply chain sources, who have apparently confirmed that there will be two versions.

Digitimes? source reckons the new tablet will be unveiled at the iWorld/Macworld conference which is scheduled to take place January 26.

The iPad 3 has been at the centre of plenty of rumours over the last few months, with many experts expecting the screen resolution will see a significant increase. If the rumours are true the iPad 3 will come with a 9.7-inch screen with a QXGA resolution, which is an impressive 1536?2048.

Other upgrades being tipped for the new tablet are a A6 processor, two cameras, 5 and 8 megapixels respectively, and a new battery that could be as high as 14,000mAh (the battery tech of the iPad 2 is a mere 6,500mAH). So it could feasibly have a battery life of upwards of 20 hours which would be ideal for heavy gamers and film buffs alike.

As for two new versions of the iPad ? this does make sense, but only if Apple is looking to take Amazon on at its own game and offer a budget-friendly tablet and then make its money back from apps and other media.?Its worked for the Kindle Fire so far, so why not the iPad?

InterOil Is Inches From Finalizing $6 Billion LNG Project (The Motley Fool)

In my last article on InterOil (NYSE: IOC - News), I discussed how close the company was to finalizing its $6 billion Papua New Guinea LNG project. Now, they have struck another preliminary sales agreement with Chinese company ENN and moved even closer to investing in the project.

Moving closer with each deal
The Papua New Guinea LNG project is InterOil's joint venture with Pacific LNG and will have an initial capacity of 5 million tons per annum (mtpa), to be expanded to 10 mtpa in phases. InterOil plans to invest $6 billion in its newest venture. Generally, for investing in any LNG project, companies look to secure around 85% in supply agreements of the total capacity.

After striking preliminary sales pacts with Gunvor, Noble (NYSE: NBL - News) and Philippines' EWC, InterOil has sealed a commitment for 2.3 mtpa. With the ENN deal, whereby InterOil will supply 1 to 1.5 mtpa of LNG for a period of 15 years, the commitment stands at 3.3 mtpa to 3.8 mtpa, just a tad short of 4.25 mtpa or around 85% of the total capacity. So, InterOil is now very close to realizing the project.

The riches
The world's primary energy mix is going through a drastic change, with natural gas the fastest-growing resource and almost coming at par with coal and oil.

The surge in demand is expected to be the steepest in Asia, especially China and India. No wonder, then, that oil companies have been flocking to areas that promise rich natural gas reserves. The South Pacific, with countries like Papua New Guinea and Australia, is one such region. ConocoPhillips (NYSE: COP - News) is already working with Australia Pacific LNG, while Chevron (NYSE: CVX - News), Royal Dutch Shell (NYSE: RDS-A - News; NYSE: RDS-B - News) and Apache (NYSE: APA - News) also got a foothold through the Wheatstone LNG project. Exxon (NYSE: XOM - News), too, is setting up an LNG export facility in the Papua New Guinea fields. What adds to the attractiveness of the area is its proximity to the lucrative markets of Asia.

Foolish bottom line
Given the prospects of investing in an LNG project in the South Pacific region, InterOil is on its way to boost its top line. The company has already secured a big percentage of its initial capacity, and is expecting to enter into more supply contracts in the next few months. So, Fools, keep an eye on this one.

China premier urges protection of farmers' rights

Chinese Premier Wen Jiabao has urged officials to share profits from the development of rural land with the millions of farmers who have to give it up.

Wen's speech to officials at a work conference Tuesday comes a week after southern Chinese officials gave in to protesting villagers after a two-week standoff with police over a land dispute.

He says China can no longer sacrifice farmers' land rights for the sake of reducing the cost of urbanization and industrialization.

Last Wednesday, the village of Wukan called off protests that had driven out local officials after a provincial party official agreed to release detainees and return some confiscated land to farmers.

Land disputes cause tens of thousands of protests in China every year.

Balloon Juice ? In The Business Of Giving You The Business

Kind of a depressing WaPo piece here about America?s House of Not So Commons and politics increasingly being a rich person?s game:

Between 1984 and 2009, the median net worth of a member of the House more than doubled, according to the analysis of?financial disclosures, from $280,000 to?$725,000 in inflation-adjusted 2009 dollars, excluding home ?equity.

Over the same period, the wealth of an American family has declined slightly, with the comparable median figure sliding from $20,600 to $20,500, according to the Panel Study of Income Dynamics from the University of Michigan.

The comparisons exclude home equity because it is not included in congressional reporting, and 1984 was chosen because it is the earliest year for which consistent wealth statistics are available.

The growing disparity between the representatives and the represented means that there is a greater distance between the economic experience of Americans and those of lawmakers.

That particular understatement could power multiple suns.? Being a career politician is, well, a very lucrative career.? Combine this with the fact that maybe 10-15% of House districts are ever truly competitive in an election by design and you start to understand just how depressing the chore of fixing Congress is.? Some 90% disapproval for the institution, majorities now saying that their own Representative needs to be tossed, but maybe 60 out of 435 seats will change hands, at most, 80.? The other 350 or so are in zero danger of losing their seat even in an election year where the House has roughly the same approval rating as breeding velociraptors down the hall from a hospital neonatal ICU.

The Senate fares no better of course and is actually in many ways far worse, but if you should still somehow be wondering why it seems like everyone with ?Rep.? in front of their name has no idea how the 99% actually lives, there?s a distinct, structural reason for that.? Also, good luck ever getting these clowns to agree to term limits, which would be a vital component of any fix.

For the one percent, by the one percent.? Could you imagine more than one percent of Congress ever consisting of pipe-fitters, school teachers, auto mechanics, computer engineers, or nurses?? It might be good for America.? It would be slightly less good for people with a net worth of $725,000 or more, which is why it wouldn?t happen.

All the kvetching about the Presidency is one thing, but until we strip mine the professional grifters out of Congress, ain?t nothin? gonna change, bro.

Description by OLDIES.com:

Count Basie, whose career spanned fifty years, was one of the most popular big band leaders from the Swing Era to the 1980s. These two albums were originally released by Columbia Records in the 1940s. Featured performers include Jimmy Rushing, Helen Humes, Bob Bailey, Buck Clayton and Don Byas.

Product Description:

Personnel: Helen Humes, Jimmy Rushing (vocals); Don Byas (tenor saxophone); Buck Clayton (trumpet).

Recording information: 05/19/1939-08/09/1946.

The Collectables label is becoming well known for reissuing two albums on one CD, and they've done it again here with Blues by Basie and Dance Parade, originally on microgroove LP vinyl from the Columbia label. The "Blues" recording has every conceivable number the Count Basie band did in 1941 and 1942 with "blues" in the title, and there are four bonus tracks, two featuring vocals by Jimmy Rushing, and one from Helen Humes. Dance Parade hails circa 1945, 1946, and 1949, with one recording from 1939, including a lot of solid swing and some boogie-woogie, a style Basie himself is not closely associated with. Rushing comes back one more time. Though not viewed in the big picture as essential Basie recordings, together they tell a fine tale about what the band was up to, shortly before the war-induced U.S. recording bans. ~ Michael G. UN, Iraq agree on Camp Ashraf resettlement plan

(AP) ? The United Nations and the Iraqi government have signed an agreement to relocate several thousand Iranian exiles living in a camp in northeastern Iraq, the U.N.'s office in Baghdad announced Sunday.

But it's not clear yet whether the camp's residents have signed off on the deal.

In a statement late Sunday, the United Nations Assistance Mission for Iraq said the agreement establishes a process to move the residents of Camp Ashraf to a temporary location. It did not give a timeline for the move or specify the new location.

A statement from U.S. Secretary of State Hillary Clinton said the residents would be moved to Camp Liberty, a former U.S. military base near the Baghdad International Airport.

"At this new location, the UN High Commission for Refugees will be able to conduct refugee status determinations for the residents of Ashraf ? a necessary first step toward resettlement to third countries," the statement said.

The People's Mujahedeen Organization of Iran first moved to Camp Ashraf during the regime of Saddam Hussein, who saw the group as a convenient ally against Tehran. The group is committed to the overthrow of the Iranian regime, and sided with Iraq in the war against Iran in the 1980s.

The group carried out a series of bombings and assassinations against Iran's clerical regime in the 1980s and fought alongside Saddam's forces in the Iran-Iraq war. But the group says it renounced violence in 2001. U.S. soldiers disarmed them during the invasion of Iraq in 2003.

Prime Minister Nouri al-Maliki has been determined to close down the camp, located in barren terrain northeast of Baghdad about 50 miles (80 kilometers) from the Iranian border, by the end of December. His government considers the camp as an affront to Iraq's sovereignty.

Last week, an Iraqi government spokesman said the government was working out a solution to the situation at Camp Ashraf with the U.N. and would allow the camp to stay open into January as residents are being relocated. At the time, representatives of the residents suggested they would be willing to move, as long as their security was provided for.

Under the agreement outlined by the U.N., the international organization will monitor the relocation process and then a team from the U.N.'s refugee agency will be deployed at the new location to process the refugee claims.

The Iraqi government will be responsible for the exiles' safety during that time, and will have a liaison officer from the Ministry of Human Rights involved in the relocation, the U.N. said.

"I would like to highlight that the government is exclusively responsible for the safety and security of the residents both during their transfer and in the new location until they leave the country," said Martin Kobler, Special Representative of the United Nations Secretary General for Iraq.

The Iraqi government's vow to close Camp Ashraf had raised concerns that forcibly removing its 3,400 residents would result in violence. The U.N. has said that at least 34 people were killed in a raid on the camp by Iraqi security forces last April.

Representatives of the camp could not be reached Sunday evening. They sent out a press release Sunday evening saying that rockets had been fired on their camp. No casualties were reported. There was no way to immediately verify the claims.

The People's Mujahedeen has been branded a foreign terrorist organization by the United States, a designation now under review by the State Department. It has been removed from similar blacklists in Europe.

What Are the Proper Ways to Respond to Gifts? [Ask Lifehacker]

What Are the Proper Ways to Respond to Gifts?Dear Lifehacker,
With the holiday coming up, I'm trying to prepare myself for the gifts I'll be receiving. I don't really know when and how to respond to gifts that are too expensive, too lousy, or just plain poorly thought out. Are there any simple etiquette rules to properly responding to gifts?

Sincerely,

Unsure How to Say Thank You

Dear Unsure,

It's true that while the holidays can be a delightful experience for the giving and receiving of gifts, they can also put you in a bit of a predicament if you receive a gift from someone you don't expect, if a gift is way better than what you gave, or if the gift is just totally wrong for you. We'll take a look at the best ways to handle these situations and when it's necessary to send a thank you card.

How to Respond to Gifts Right Away

What Are the Proper Ways to Respond to Gifts? Most people probably don't have a lot of trouble responding to gifts because all it really takes is a smile and a "thank you." Still, there are those among us who struggle a bit to either fake it when we get a bad gift, or to offer up an adequate amount of appreciation to a really good gift. Here's some help if you need it.

The ones you don't like: Like it or not, we all receive a gift once and a while that we don't like, doesn't fit our personality, or that we already own. Psychology Today has a simple solution: respond to the "spirit of the gift" instead of the gift itself. As an example, author Gretchen Rubin talks about receiving a giant gardenia and thinking about her own limitations of where it could go instead of simply responding to the reasoning (that she liked gardenias) the gift was given to begin with. Of course, if the spirit was misaligned, say, a gym membership if you're slightly overweight, you best bet might be to just smile and nod.

The ones you do like: Showing proper gratitude for a gift is often just as difficult as hiding the fact you don't like something. In this case, it's best to just fall in line with the old rules of etiquette. Look the giver in the eye and say "thank you." If you like, you can throw in another "thank you" later on, but if you're in one of those round-table gift exchanges families like to do, you don't want to stress the importance of one gift over another. If it's a good gift that comes after years of poorly thought out gifts, you can always follow up with them later with a card or in-person to stress the greatness of the gift.

What to Do if You Receive a Gift Significantly More Expensive Than the One You Gave

What Are the Proper Ways to Respond to Gifts? There are two possible scenarios where you might get into a little hot water with gift receiving. You either didn't buy someone a gift at all, or you purchased a gift that is significantly cheaper than what they give you.

If you're given a gift but didn't purchase one: Unless you're dealing with someone close who you really should have purchased a gift for, you don't need to worry. In an interview with CNN, etiquette teacher Peter Post sums it up nicely, "There's nothing about having received a gift that says you have to give a gift in return." In other words, be thankful, but don't sweat not purchasing anything yourself.

If your gift sucks in comparison to what you receive: As it turns out, studies have shown you'll appreciate a gift regardless of its price, so in theory, you shouldn't be worried if you've given someone a coffee cup when they bought you a new stereo system. A big gift is given because the giver wants to give it, so you should be in the clear if you can't reciprocate on the cost. Besides, there's nothing you can really do if the exchange has already happened, but make sure you quickly send out a "thank you" card.

The Proper Etiquette of Thank You Cards

What Are the Proper Ways to Respond to Gifts?Thank you cards are a difficult thing to keep track of, but according to etiquette expert Cindy Post Senning, they're still necessary. While her advice revolves around children, the trait of sending thank you cards is supposed to carry through to adulthood. Thankfully, she notes that email is a perfectly acceptable means to communicate your thanks, so you don't need to pull out the pen and paper unless you want to.

If you're struggling with what to say in the card, WikiHow notes that if you received a gift card, it's a good idea to say what you spent it on in the thank you card. This way it tells them you enjoyed it and gives them an idea of what you spend your money on for future reference. You can apply the same logic to any gift you received. For instance, you might describe how your new bright purple sweater from your Aunt was "a hit at work."

Jezebel has a bunch of tips on when and how to give thank you cards, noting that you should keep it relevant and don't get sidetracked with other conversations. You should always send thank you cards if you received a gift in the mail, but if you received something in person, it's only really important to send out a note if it was a substantial gift. There's no hard deadline for sending these out, but the sooner you do it, the less likely you are to forget.

In general, the rule seems to be: be appreciative, show your appreciation in a thank you card, and don't sweat it too much if your gift isn't as expensive as one you received.

Sincerely,

Lifehacker

NFL Week 16: New York Giants (7-7) at New York Jets (8-6)

It?s the biggest game in the history of the Giants-Jets battle for New York as the loser of Saturday?s game is likely out of the playoffs and has to hear the other team brag about owning the city for the entire offseason. Plus Giants coach Tom Coughlin?s job is on the line and Jets coach Rex Ryan?s credibility is at stake.

The Jets hold the final AFC wild-card spot with Cincinnati, Tennessee, Oakland and San Diego lurking, while the Giants need to win the log-jammed NFC East to qualify for the playoffs. They?re one game back of first-place Dallas and one ahead of Philadelphia. Those teams face each other Saturday before the Giants host the Cowboys in Week 17.

Jets QB Mark Sanchez is on a career-best pace for yards and touchdown passes, but he?s completing only 56.9 percent of his passes. The Giants? defense ranks 28th in giving up 385.1 yards per game. New York has lost five of its past six games after a 6-2 start.

Though Giants QB Eli Manning is having one of his best seasons ? completing 61.6 percent of his passes for a career-high 4,362 yards ? he?s thrown 10 interceptions in his last seven games after having just five in his first seven. The Jets? defense ranks seventh against the pass, yielding 205.1 yards per game, but they?ve only come up with three interceptions the past six games after grabbing 13 in their first eight.

The Giants average 3.4 yards per attempt on the ground but have been better of late, averaging 5.2 yards per carry in the past two games. The Jets allow fewer than 4 yards per carry but have been inconsistent at times. The Giants need to pound the rock with Brandon Jacobs and Ahmad Bradshaw to set up their play-action passing game.

STREAKS, STATS AND NOTES ? After week of trash talk, most of it from Jets coach Rex Ryan, teams meet in showdown of New York-area rivals with plenty of playoff implications. If Giants beat Jets and then Dallas next weekend, they win NFC East and return to playoffs for first time since 2008. Two wins will likely clinch Jets a third straight wild-card appearance under Ryan. ? Three players in game have played for both Ryan and Giants coach Tom Coughlin: Jets WR Plaxico Burress and QB Mark Brunell, and Giants P Steve Weatherford. ? Giants have lost five of last six, but have won last four regular-season games against Jets. ? QB Eli Manning has thrown for franchise-record 4,362 yards, and with 25 TDs joined Peyton Manning, Brett Favre, Dan Marino and Drew Brees as only QBs with at least 3,000 yards and 20 TDs in seven straight seasons. Manning, who won only other start vs. Jets, has 14 TDs in fourth quarter, tied for most in a season. Also has three 400-yard games, tied for NFL?s single-season mark. ? WR Victor Cruz has 1,194 yards receiving and needs 150 in last two games to top Amani Toomer?s team record set in 2002. ? Hakeem Nicks has 1,096 yards receiving, making him and Cruz the first pair of Giants WRs to have 1,000 yards in same season. ? DE Jason Pierre-Paul has 13? sacks, and at least a half-sack in 10 of 14 games this season. ? Jets looking to improve to 7-1 at home, which would match best mark in team history ? last set in 1998. ? Burress facing Giants for first time since they released him in 2009 after accidentally shooting himself in November 2008. Later served 20 months in prison on gun charge, and signed with Jets less than two months after release. ? QB Mark Sanchez needs 283 yards passing to top career best of 3,291 set last season. ? RB Shonn Greene needs 59 yards rushing to reach 1,000 for the first time in three-year career. Leads AFC with four TDs rushing in December. ? RB LaDainian Tomlinson has 13,599 yards rushing, 64 from passing Jerome Bettis for fifth place on c areer list. ? WR Santonio Holmes has TD catch in four straight games, and he and Burress are only duo from same team in AFC with at least eight TD receptions. ? KR-RB Joe McKnight leads NFL with 32.3 yard kickoff return average, but status was uncertain as he recovers from separated right shoulder and hyperextended right elbow.

Michael Jacques Sentenced To 14 Years For Burning Black Church After Obama Election

The hate crime which Michael Jacques committed against the Macedonia Church of God in Christ stung not only the Springfield, Mass. region, but indeed the nation. Having been raised in Western Massachusetts, it stung me as well,? Richard DesLauriers, Special Agent in Charge of the Boston FBI, said in a statement.

The church was rebuilt with help from volunteers and supporters from around the country and opened for services this summer.

After being implicated in the arson by Benjamin Haskell, one of his accomplices, Jacques was brought in for questioning by the Massachusetts State Police and admitted his involvement in the crime after a six-hour interrogation. Before his trial in April, Jacques told a federal judge he was pressured into a false confession while suffering withdrawal from painkillers and nicotine. The judge ruled that the confession was admissible.

Haskell told police that Jacques ?was angry that the country was going to have an African American president and that the blacks and Puerto Ricans would now have more rights than whites,? according to court documents.

After a three-week trial, Jacques was convicted of numerous federal civil rights charges, including destruction of religious property and conspiracy against civil rights. In addition to serving almost 14 years in federal prison, followed by four years of supervised released, he must pay nearly $1.6 million in restitution.

?This sentence sends a powerful message that racial violence and intimidation have no place in our society,? Assistant Attorney General Thomas Perez said in a statement.

Council approves church property camping program

ADVERTISEMENTS

The City Council approved a one-year pilot program to allow a limited amount of camping at churches and nonprofit organizations on Wednesday morning.

The resolution authorizing the program was introduced by Housing Commissioner Nick Fish, who said it supplements other efforts by the city and Multnomah County to end homeless. The Multnomah County Commission is expected to approve a similar program Thursday, and to also approve spending $750,000 to help find permanent housing for those who take advantage of it.

The program approved by the council will allow camping in up to four motor vehicles owned or operated by churches and non-profit agencies in the cities that participate in it. They must provide access to water and restroom facilities.

Fish wrote the resolution with a number of religious and non-profit organizations, including Ecumenical Ministries of Oregon. It was inspired in part by the ongoing homeless camp at Northwest Third Avenue and Burnside Street known as Right 2 Dream Too. The program does not include the camp, however.

Dozens of homeless people and their supporters testified by the council vote. Many called the program inadequate considering the number of people needing housing in Portland, and Fish agreed.

"This resolution does not solve the problem," Fish said. "But when people of good faith come to us and ask us to do something, I think we should agree. It is not intended to solve the problem or be comprehensive in scope."

The city has policies that prohibit public camping. It is defending the legality of those policies in federal court. The Oregon Law Center has filed a lawsuit against the city, saying the policies are unconstitutional.

Defending Portland's efforts to end homelessness, Fish noted the city is sending millions of dollars a year on housing program. It recently funded Bud Clark Commons, formerly called the Regional Access Center, which provides apartments to some of the city's most vulnerable homeless people.

The resolution passed with the support of Commissioners Fish, Randy Leonard and Dan Saltzman. Mayor Sam Adams and Commissioner Amanda Fritz were absent.

Facebook ordered to improve its privacy

Facebook users will enjoy tighter privacy controls after the social networking giant was ordered by the Republic of Ireland's Data Protection Commissioner to change how it handles personal data.

The company was issued with a raft of recommendations including deleting personal information sooner and allowing users better control on the use of data.

The Office of the Data Protection Commissioner yesterday published the outcome of its audit of Facebook Ireland, which was carried out over the last three months.

The Dublin headquarters is the firm's international operation, and provides a range of online technical, sales and operations support to Facebook users and customers across Europe, the Middle East and Africa.

Deputy Data Protection Commissioner Gary Davis, who led the audit, said it was the most comprehensive and detailed ever undertaken by his office.

The social networking site, which has more than 800 million users, has agreed to the changes.

"We set ourselves a very ambitious target for completion and publication as both this office and Facebook felt it was important that the outcome be published and opened to public comment and scrutiny," Mr Davis said.

"It is important to recognise that Facebook Ireland, as recently as September 2010, was designated responsibility for all users outside of the US and Canada."

Recommendations include:

  • Deleting information held on users and non-users via so-called social plug-ins and the deleting of data held from user interactions with the site much sooner.
  • Increased transparency and controls for the use of personal data for advertising purposes.
  • An enhanced ability for users to control tagging and posting on other users' profiles.
  • Data Protection Commissioner Billy Hawkes said Facebook had agreed to make "best practice" improvements over the next six months, with a review to take place in July.

The audit focused on complaints addressed by the Europe-versus-Facebook group, the Norwegian Consumer Council and a number of individuals.

Richard Allan, director of public policy with Facebook EMEA, said: "The people who use Facebook take privacy and data protection seriously and so do we.

Tagging

"We work closely with privacy commissioners and regulators around the world to demonstrate our compliance with legal requirements and to improve our policies and practices."

Facebook confirmed it was committed to:

  • Enhancing the ability of European users to control tagging and posting on other user profiles and their addition to groups by friends.
  • Changing a number of policies relating to retention and deletion of data, including how data is logged when people access websites with social plugins to minimise the amount of information collected about people who are not logged into Facebook.
  • Working with the Data Protection Commissioner to improve the information that people using Facebook are given.

Did CM Punk start a revolution?

Did CM Punk start a revolution?During a live broadcast of Raw on June 27, CM Punk sat cross-legged on the entrance ramp in a vintage ?Stone Cold? Steve Austin T-shirt and delivered a monologue that has become the sports-entertainment equivalent of William Wallace?s speech to the war weary Scots at the end of ?Braveheart.? A pointed, stirring battle cry that both indicted the enemy and roused the people, the call to arms led legions of WWE fans to unite under one word ? change.

Frustrated with the direction of an industry he's loved his entire life, The Straight Edge Superstar wanted to see a younger generation take charge and in the weeks since his incendiary rant he fought an uphill battle to make it happen.

At WWE TLC, the ?change? Punk spoke about finally began to take shape. On that night in Baltimore, not only did Punk successfully defend his WWE Championship in a thrilling main event, but Zack Ryder grabbed the United States Championship and Daniel Bryan won the World Heavyweight Title.

Something was stirring in WWE and Punk could feel it. It was an emotion he expressed bluntly on Twitter:

CM Punk tweet

It's all in the reflexes.Pale and unshaven with a hood yanked over his sleepless eyes, CM Punk may not look like the new face of WWE, but the face is the least distinctive element of this champion?s appearance. What sets The Straight Edge Superstar apart from Hulk Hogan, Bob Backlund, John Cena and every other well muscled American man that?s carried sports-entertainment?s most coveted title is his alternative appeal ? the garage rock aesthetic, the blue jean and black hoodie uniform, the arms as illustrated as the rack in a comic book store.

No matter how hard they tried to convince you otherwise, WWE Champions have rarely been cool. Bret Hart?s Michael Jackson-inspired pink leather jackets with military epaulets weren?t cool, Hulk Hogan?s Fu Manchu mustache and wispy golden hair weren?t cool and John Cena?s jean shorts and low tops were definitely not cool. The Rock and ?Stone Cold? Steve Austin were cool, but in a way that was completely foreign to the average WWE fan. They were action heroes, larger-than-life caricatures that always knew the right thing to say to the bad guy before they offed him.

CM Punk is not larger-than-life, but that?s exactly his appeal. He?s as real as it gets. He likes ice cream and Kurt Russell movies. He used to post pictures on his Twitter of oozing cheese pizzas he?d devour entirely, one would assume, by himself. He can dislocate a man?s arm with his bare hands, but that doesn?t stop him from staying up all night reading graphic novels. He?s flawed, frustrated and in love with professional wrestling ? the type of guy a WWE fan can relate to.

Zack Ryder is much the same. A young Superstar who had early success as Edge's lackey in 2006, he floundered in preliminary matches for the remainder of the decade before building his own fanbase through social media. By urging fans to like him on Facebook and follow him on Twitter during his self-produced YouTube show, "Z! True Long Island Story," the kid from the L.I. started what he called the ?Ryder Revolution? ? a grassroots campaign to get the attention of WWE. What started with a Flip camera in Ryder?s roommate?s bedroom soon became a national phenomenon. Before long, WWE fans were pumping giant foam fists and wearing spiked hair wigs as they cheered Long Island Iced-Z to a United States Title victory over Dolph Ziggler at WWE TLC.

Daniel Bryan wins the World Heavyweight Title at WWE TLC.Daniel Bryan may be the most unlikely success story of them all. A humble, 200-pound phenom from Aberdeen, Washington, the submission expert wrestled his way across the globe for a decade, earning repute as one of the world?s greatest technicians in the process. He even locked up with CM Punk in armories on the east coast when the two were standouts on the indies. But, in spite of being trained by Shawn Michaels and William Regal, Bryan never fit the preconception of what a World Champion should be. He?s pale, he doesn?t eat meat, you won?t see him riding in a limo or a leer jet and his shoes probably don?t cost more than your house.

Still, at WWE TLC, Daniel Bryan became the World Heavyweight Champion by cashing in his Money in the Bank briefcase and pinning Big Show. Suddenly, two competitors who learned their craft in the dingy gymnasiums of the independent wrestling scene were WWE?s top titleholders and a hardworking Broski was right there with them. The following night on Raw, the three Superstars stood triumphantly in the ring with their titles in hand and the WWE Universe completely behind them.

Six months removed from Punk?s sermon on the mount, change had come.

AT&T, Sprint, Samsung, And HTC Weigh In On Their Use Of Carrier IQ

carrierIQSenator Al Franken pressed certain members of the wireless industry over two weeks ago for answers about their use of Carrier IQ, the controversial monitoring software that sparked fears that our personal data was being tracked without consent. Now that the deadline has come and gone, Senator Franken had a chance to review their statements and publish them in full on his website. After reviewing each company's official responses to his questions, Senator Franken noted that he's still "very troubled" by the situation at hand.

Almost half the U.S. using smartphones, with iPhone leading gains (Appolicious)

New research from Nielsen shows that the smartphone is continuing to make big leaps in popularity in the U.S., now accounting for some 44 percent of all cellular phones being used in the country.

Apple?s iPhone leads the pack in the U.S. among smartphone manufacturers, accounting for 28.6 percent of the entire market in the country. It?s not the top platform in the country, though ? that still goes to Google?s Android platform, which holds down 44 percent of the total smartphone market.

MSNBC?s Technolog has the story, which notes Nielsen gathered its data from 25,000 U.S. cellular customers and that the smartphone market in 2009 accounted for just 18 percent of all cellular phones in the U.S. Among manufacturers, Apple is the leader, but the next biggest share of the market goes to BlackBerry maker Research In Motion with 17 percent. Next is Android device maker HTC with 15.8 percent, then the world leader in smartphones by revenue, Samsung, with 10.4 percent. The Windows Mobile platform came in fourth, accounting for 5.3 percent of all smartphones.

Among the 44 percent of people that own smartphones, more than half of them are between the ages of 18 and 34. Sixty-four percent of 25- to 34-year-olds are smartphone owners, while 53 percent of 18- to 24-year-olds own smartphones. On average, iOS users have 44 apps on their devices.

Facebook is the most-used app on both iOS and Android, Nielsen reported (which we already knew), and just under half ? 49 percent ? say they ?frequently? use their smartphones while they?re shopping. In fact, using smartphones to save money is something that a lot of owners do. Nielsen also found that 87 percent of app users ? those who have downloaded an app in the last 30 days ? used them to access a ?deal-of-the-day? website, such as LivingSocial or Groupon.

We?ve heard that Apple?s devices are growing in popularity and that demand in 2012 for the devices may be even higher than was previously expected. Sounds like we might be seeing Apple?s share of the smartphone market increasing as that market continues to grow. Of course, we?ll have to wait and see what Google and Android have to offer, but things seem to be going well for Apple.

Apple makes it legal to port Siri to an iPhone 4 (Digital Trends)

Siri-iPhone-4S-Assistant

Apple?s Siri voice assistant stands as one of the primary selling points of the iPhone 4S, which is the only device that includes the feature. Yes, many hackers have tried to put Siri on other Apple gadgets, but they have so far been unstable and otherwise severely flawed. But that is all about to change.

As Alex Heath at Cult of Mac reports, Apple has released now released iOS 5.0.1, which includes the Siri code unencrypted, making it possible ? and legal ? for hackers to port Siri to older versions of the iPhone.

The notable change to iOS 5.0.1 was first uncovered (publicly) by well-known iPhone hacker MuscleNerd, who posted the information to Twitter. MuscleNerd notes that iOS 5.0.1 is ?the first public 4S ipsw where the main filesystem keys are obtainable (due to non-encrypted ramdisks).? By un-encrypting the Siri code, Apple has made it possible to port the feature to other devices without violating Apple?s copyright.

It is entirely possible that Apple will close this loophole soon ? in fact, we?d wager that that is a highly likely scenario ? when it releases iOS 5.1. For now, however, those of you who have stuck with the iPhone 4, and choose to jailbreak your device, could very soon have Siri all to yourself.

Tantalizing Hints of Elusive Higgs Particle Announced [Updated]

News | More Science

The long-sought Higgs boson is tied to the leading theory of how quarks, electrons and other particles get their mass

Particle track in CMS detectorTRACKING THE HIGGS: A reconstructed particle collision in the CMS detector of the LHC. Image: CMS/CERN

GENEVA?The two largest collaborations of physicists in history Tuesday presented intriguing but tentative clues to the existence of the Higgs boson, the elementary particle thought to endow ordinary matter with mass.

Representing the 6,000 physicists who work on two separate detectors at the Large Hadron Collider (LHC), called CMS and ATLAS, two spokespersons said that both experiments seemed to agree, as both their data sets suggested that the Higgs has a mass close to that of about 125 hydrogen atoms. The LHC is an international facility hosted by CERN, the European particle physics laboratory outside Geneva.

"We are talking of intriguing, tantalizing hints," said CMS spokesperson Guido Tonelli, speaking to a room filled with dozens of journalists and TV crews. "It's not evidence."

The experiments, in which protons traveling at nearly the speed of light collide head-on, cannot directly detect the Higgs, because the boson would decay within a fraction of a nanosecond into other particles. Instead, physicists must search through the debris of many different types of particle decay to find precise combinations of by-products that the Higgs would produce?and different particles may well have the same signatures. A particular combination that appears more often than expected from other, "background" processes may signal the presence of the Higgs. But if it does not appear often enough compared with the expected background, it could just be a statistical fluctuation. Today, neither CMS nor ATLAS could claim to have the "3-sigma" statistical significance needed to claim evidence for a new particle?let alone 5 sigma for the accepted standard to claim a discovery. (A 3-sigma result implies a fraction of a 1 percent chance of a statistical fluke.) Instead, so far each experiment could only claim an event around 2 sigma.

Both the detectors and the LHC accelerator itself, however, have been performing better than expected; so all the ducks are now in a row for settling the question soon, according to the researchers. "The nice thing to know is that by the end of 2012?sooner if we are lucky?we should be able to say the final word," Fabiola Gianotti, the ATLAS spokesperson, said at the press conference.

"I find it fantastic that we have the first results on the search for the Higgs, but keep in mind that these are preliminary results. And keep in mind that we have small numbers," said CERN Director General Rolf-Dieter Heuer in summarizing presentations that both Tonelli and Gianotti gave during a CERN seminar earlier that day.

"I think the evidence is very encouraging, though it's still too early to be sure," comments Steven Weinberg, a leading theoretical physicist at the University of Texas at Austin and a winner of the Nobel Prize in Physics.

A generation of high-energy physicists came of age studying and testing the Standard Model of particle physics, a theory devised in the 1970s that has withstood all experimental challenges. One final piece is missing, though, and it is one without which the whole model could fall. Without the Higgs boson, physicists cannot explain how other particles have mass. The Higgs itself has mass, and going by exclusion, researchers from the LHC and from its predecessor particle colliders were able narrow down the range of its value to between 115 and 140 giga?electron volts, or GeV. (One GeV is roughly the mass of a hydrogen atom.)

Together, the LHC detectors have now reduced the allowed range further: Tonelli said that according to CMS data its mass cannot be greater than 127 GeV. That was not for lack of data?in fact, quite the opposite. "We were not able to exclude the range below 127 GeV because of excesses," or more of certain particle by-products than would be expected in the absence of the Higgs, he remarked during his seminar talk?which was an understated way of saying that the CMS experiment had actually seen hints of a Higgs existing and having a mass of 124 GeV or so. ATLAS saw excesses in a similar range of energies, although the graphs did not quite line up?the ATLAS data favor a Higgs around 126 GeV.
