High court will review EPA global warming rules

WASHINGTON (AP) — The Supreme Court agreed Tuesday to decide whether to block key aspects of the Obama administration's plan aimed at cutting power plant and factory emissions of gases blamed for global warming.

The justices said they will review a unanimous federal appeals court ruling that upheld the government's unprecedented regulation of carbon dioxide and five other heat-trapping gases.

The question in the case is whether the Environmental Protection Agency's authority to regulate automobile emissions of greenhouses gases as air pollutants, which stemmed from a 2007 Supreme Court ruling, also applies to power plants and factories.

The court's decision essentially puts on trial a small but critical piece of President Barack Obama's toolbox to tackle global warming — a requirement that companies expanding existing industrial facilities or building new ones that would increase overall pollution must evaluate ways to reduce the carbon they release, as well. For many industrial facilities, this is the only way heat-trapping gases will be regulated, until the EPA sets national standards.

That's because the administration's plans hinge on the high court's 2007 ruling in Massachusetts v. EPA which said the EPA has the authority, under the Clean Air Act, to limit emissions of greenhouse gases from vehicles. Two years later, Obama's EPA concluded that the release of carbon dioxide and other heat-trapping gases endangered human health and welfare, a finding the administration has used to extend its authority beyond automobiles to develop national standards for large stationary sources.

The administration currently is at work setting first-time national standards for new and existing power plants, and will move on to other large stationary sources. But in the meantime, the only way companies are addressing global warming pollution is through a permitting program that requires them to analyze the best available technologies to reduce carbon dioxide, the chief greenhouse gas.

The president gave the EPA until next summer to propose regulations for existing power plants, the largest unregulated source of global warming pollution.

"From an environmental standpoint, it is bad, but not catastrophic," said Michael Gerrard, a law professor at Columbia University and director of its Center for Climate Change Law. Gerrard said it would have been far worse if the court decided to question the EPA's conclusion that greenhouse gases endanger human health and welfare.

Environmental groups generally breathed a sigh of relief that the court rejected calls to overrule its 2007 decision or review the EPA's conclusion about the health effects of greenhouse gas emissions.

"It's a green light for EPA to go ahead with its carbon pollution standards for power plants because the court has left standing EPA's endangerment finding," said Joanne Spalding, the Sierra Club's senior managing attorney.

But a lawyer for some of the business groups involved in the case said the court issued a more sweeping ruling.

"Read in its broadest sense, it arguably opens the door to whether EPA can regulate greenhouse gases from stationary sources at all," said Roger Martella, a partner with the Sidley, Austin law firm in Washington.

The regulations have been in the works since 2011 and stem from the landmark Clean Air Act that was passed by Congress and signed by President Richard Nixon in 1970 to control air pollution.

The administration has come under fierce criticism from Republicans for pushing ahead with the regulations after Congress failed to pass climate legislation, and after the administration of President George W. Bush resisted such steps.

In 2012, a three-judge panel of the U.S. Circuit Court of Appeals for the District of Columbia concluded that the EPA was "unambiguously correct" in using existing federal law to address global warming.

The judges on that panel were: Then-Chief Judge David Sentelle, who was appointed by Republican President Ronald Reagan, and David Tatel and Judith Rogers, both appointed by Democrat Bill Clinton.

The case will be argued in early 2014.

US stocks mixed as investors wait on debt news

There's deal talk in Washington. On Wall Street, it's wait-and-see.


The big stock indexes were mixed on Tuesday as Republican and Democratic leaders in the Senate reported that a deal over the nation's borrowing limit appears to be getting closer.


Unless the borrowing limit is raised, the U.S. will bump up against a Thursday deadline that could lead to a default on government debt. That possibility has rattled markets all month.


There was reason for Wall Street to be noncommittal on Tuesday. For one, it wasn't clear whether House Republicans will go along with whatever the Senate works out. Also, any deal reached this week might simply set up another showdown a few months down the road.


In late morning trading, the Dow Jones industrial average was down three points at 15,298. The Standard & Poor's 500 index was up one point at 1,711. The Nasdaq composite was up nine points at 3,824.


Six of 10 industry groups in the S&P 500 rose, with the biggest declines in consumer discretionary and utility stocks. Financial and technology stocks had the biggest gains.


The general direction for stocks was down all morning, with indexes about flat as midday neared. It was clear that traders were hanging on every word out of Washington. The losses on the Dow shrank by about 40 points during a short press conference by House Speaker John Boehner.


Uri Landesman, president of Platinum Partners, said he thinks there will be a deal, but that investors are making a mistake to focus on it. The economy has more risks than that. He believes U.S. growth is likely to be more sluggish than anticipated, and conflicts with Iran and Syria could blow up. Investors aren't accounting for the risk of "a short-term spike in energy prices, which would be very deleterious to a shaky economy," he said.


"Oil could go to $140 short-term," Landesman said. "Trust me — this global economy cannot handle $140 oil."


Oil prices spiked that high in 2008. On Tuesday, the price of oil fell 40 cents to $102.


Citigroup rose 11 cents to $49.71, reversing losses from earlier in the morning after it reported a smaller profit because of a drop in its bond business, investment banking and mortgage refinances.


Johnson & Johnson rose $51 cents to $90.30 after reporting a bigger third-quarter profit and raising its earnings forecast for the year.


The yield on the 10-year T-note rose to 2.72 percent, from 2.69 percent on Friday. Bond trading was closed Monday for Columbus Day.


Stocks in Europe rose. Germany's DAX rose 0.7 percent and Britain's FTSE 100 rose 0.8 percent.

Gambia charges journalist with sedition


Banjul (Gambia) (AFP) - Gambian prosecutors on Thursday charged a journalist with sedition for disseminating "false" news about President Yahya Jammeh.


Fatou Camara, who was Jammeh's public relations chief until August, was arrested last month over information published on US-based news website the Freedom Newspaper.


She appeared in court Thursday and was charged on two counts of sedition.


She is accused of publishing false news "with intent to tarnish the image of the president" and of "giving false news through the Internet" to the editor of the news site, according to the charge sheet read in court.


Camara, who denies the charges, was released on bail and is expected back in court on October 28.


Gambia, the smallest state on mainland Africa, is ruled by Jammeh with an iron fist.


Media laws describing crimes of sedition, slander and publication of false information implemented in 2004 are so restrictive that an article, cartoon or even gesture seen as insulting to Jammeh can land a person in jail.

Car bomb in northern Syria kills at least 15

BEIRUT (AP) — A car bomb in a rebel-held town in northwestern Syria killed at least 15 people and wounded dozens in a crowded outdoor market Monday, setting cars on fire and sending people running in panic, two activist groups said.


The bomb went off in the town of Darkoush in Idlib province, according to the Britain-based Syrian Observatory for Human Rights and the Local Coordination Committees. The marketplace was busy with shoppers on the eve of Eid al-Adha, a major Muslim holiday.


It was not clear who carried out the bombing and why they attacked a civilian target in a rebel-held area. Syria's conflict has seen an increasing use of car bombings, but most have been carried out against regime targets, usually by jihadi fighters among rebels.


The Observatory put the death toll at 27, while the Committees said 15 were killed. Such discrepancies often occur in the aftermath of such attacks.


An amateur video posted on the LCC's Facebook page shows several cars on fire in a street full of debris. People are seen running in panic as smoke billows from the area, and several shops and apartment buildings appear heavily damaged. Another video shows men carrying two bodies and placing them in a blanket. The videos appeared genuine and corresponded to AP reporting on the events.


Just a day earlier, two car bombs exploded near the state TV building in Damascus. The SANA news agency said the TV's headquarters in Umayyad Square was damaged in the blast, but there was no word on casualties.


Meanwhile, the International Committee of the Red Cross in Geneva confirmed Monday that three of its employees and one from the Syrian Red Crescent were released, a day after being kidnapped by gunmen in Idlib province. The fate of three other ICRC employees who were also kidnapped Sunday was not immediately known.


The Observatory and a local activist in Idlib said the aid workers had been seized by an al-Qaida-linked group, the Islamic State in Iraq and the Levant, but there was no claim of responsibility.


Much of the Idlib countryside and other parts of northern and eastern Syria have fallen under the control of rebels, many of them Islamic extremists. Kidnappings have become common, particularly of aid workers and foreign journalists.


The intensity of the conflict, which has left more than 100,000 dead, has not abated in the past two weeks — even as inspectors from the Organization for the Prohibition of Chemical Weapons press on with their work to destroy the country's chemical weapons stockpile.


The watchdog agency won a Nobel Peace Prize last week, in a powerful endorsement of its Syria mission.


Ahmet Uzumcu, head of the OPCW, said Monday that inspectors have so far visited five of at least 20 sites linked to chemical weapons. The BBC quoted him as saying that one abandoned site was in rebel-held territory and that in other cases, routes went through opposition-controlled areas, preventing access.


"They change hands from one day to another, which is why we appeal to all sides in Syria to support this mission, to be cooperative and not render this mission more difficult. It's already challenging," he told the BBC.


The mission stems from a deadly Aug. 21 attack on opposition-held suburbs of Damascus in which the U.N. determined the nerve agent sarin was used. Hundreds of people were killed, including many children. The West says the Syrian government was responsible, while Damascus blames the rebels.


Monday marked the date that Syria formally joined the OPCW, 30 days after submitting its application at the United Nations.


In an interview with the Lebanese Al-Akbar newspaper, Syrian President Bashar Assad was quoted Monday as saying that his country stopped manufacturing chemical agents in 1997 because they became an "outdated deterrent." He said Syria has since concentrated on its missile capabilities.


Damascus is believed to have thousands of long-range missiles that can reach targets almost anywhere inside Israel, its arch enemy.


"Developing Syria's missile deterrent force that can be used from the first moments of war ended the necessity of chemical weapons,' Assad was quoted as saying.


Nonetheless, Assad said, Syria is suffering a "moral and political loss" in handing over its chemical weapons.


Asked about the OPCW getting the Nobel prize, Assad attempted an apparent joke, saying, "this prize should have been mine."


U.S. Secretary of State John Kerry and the U.N-Arab League envoy for Syria said an international conference to set up a Syrian transitional government must be organized and held as soon as possible.


Kerry said Syria urgently needs a transitional government and that it is imperative to get the so-called "Geneva II" conference organized by a mid-November target.


He also said Assad "has lost the legitimacy to be able to be a cohesive force that could bring people together."


However, it's not clear if the Syrian political opposition will attend.


In other developments, Syrians lost power Monday in several regions in the country's center as well as areas on the Mediterranean coast but there was no indication if the power cut was related to the conflict or result of sabotage.


SANA quoted Minister of Electricity Imad Khamis as saying that a malfunction at a power station had caused the outage. Khamis said maintenance work was underway and that power will gradually return in the coming hours.
